Woodson has 60 days from the fist signature to collect enough signatures to force a recall election. The Clerk has 35 days to validate the signatures.
Weaver may include a justification statement to be included on the ballot.

All parts of the signature line must be filled in by the signer or the signature may be declared invalid as in the jackie Poplar recall.

Circulators must live in the City of Flint. This was challenged in 2008 by the Federal lawsuit Bogaert vs Land which challenged the constitutionality of this provision. While a federal judge entered a preliminary injunction ordering Secretary of State Land to count the discarded signatures in Andy Dillon's recall that had been declared invalid, this section has not been changed.

An election for mayor must occur within 60 days.

The Interim Mayor will be the City Administrator per the Charter.

A recall election will not trigger an Emergency Manager as the law specifies an Emergency Manager can only be triggered by a financial crisis and currently, although the City is technically under receivership, there is no financial crisis.

RTAB ( Receivership Transition Advisory Board) is not dictating how the City is to be run. They can only approve or disapprove financial matters. Chairman Fred Headen is extremely qualified and continues to tell city officials RTAB cannot get involved in their internal squabbles.

While Sabuda discussed what the City officials are doing to improve the collections of water bills, RTAB cannot order it to be done. That is strictly a City Administative decision.

This recall cannot be tied into a recall of the Governor over the decision to use the Flint River without the additives to prevent corrosion. The Law does not allow a recall on the Governor for his actions in his first term of office.

There must be an election for a candidate to finish the mayor's term of office if she is recalled.

There is currently a flyer going around with a vague statement to not believe (unnamed) rumors and lies. The flyer states voters should not sign the petition.

While I don't have a dog in this fight, I am appalled that the rumors lies and innuendoes appear to be coming from the Mayor's supporters.

And the decision to place unpaid water bills on the tax rolls is strictly based on law. However, people have been refusing t pay their water bills a long time and they were never informed of the consequences. Even when asked to pay their sewer portion, many did not. Many even lost their credits over not following the guidelines. According to statements by Sabuda to RTAB over turn off notices, 30% of the homes were already abandoned.

Yes the water was poisoned, but when council submitted a plan to not require payment, the City Administrator was in control and council had no authority.

Council's lawsuit may eventually come to a compromise.

"The Water Fund is the key" Sabuda told Headen and Finney at the April 12th TAB meeting.

(Michael Townsend resigned as he is taking another position and Ferguson was excused.)

This exchange came after a discussion of more changes to the pension fund. Sabuda described how the Emergency Manager had 3 pension grups with no assets. This "was done for convenience when the system moved from Flint to MERS That was to ensure that pension funds were paid monthly".

Sabuda worked with MERS (Municipal Employee Retirement System) and moved retirees into the proper group where there were assets and active employees paying into the fund. That lowered the value from $42 million to $36 million in actual contributions.

With 3 actuarial options, the City chose option #2 which reduced the payment to $20.6 million on July 1, 2017: $24 million for 2018; 26 million in 2019; 31 million in 2020; $36 million in 2021; and $37.8 million in 2022 etc.

The City and MERS smoothed the assets and moved assets between retiree groups to achieve the contribution rates. This ensures thre general fund will stay balanced for a 5 year period although the pension fund will decrease dramatically. Sabuda indicated that with an improve cash flow and elimination of expenditures, the plan would work. There are currently 1800 retirees and 380 active employees that pay into the system.

After Finney questioned Sabuda about the comfort zone of the City, Sabuda noted that years 3 through 5 would be a major hurdle.
"The Water Fund is the key" Sabuda said repeatedly. he indicated that if collections remained in the 80% level or better, that would be the answer. Sabuda indicated that by working on collections, the funds would take care of the future of Flint. One problem Sabuda discussed was that when turn offs were ordered, about one third of the turnoffs were vacant homes.

The current water collection plan was created by talks with the City manager Jones, the Mayor and Sabuda. Eric Cline of Treasury was at the meeting.

It should be noted that there was discussion that Genesee County Treasurer Deb Cherry had refused to put the water liens on the 2017 tax rolls and the City was working to get her to change her mind.
