Councilman Kerry Nelson should be removed from office for agreeing to pay a Flint Journal newspaper carrier $150,000 and for other misdeeds, according to a resident who launched a recall attempt.

Antionette Hardy filed petition language Thursday that targets the 3rd Ward councilman, accusing him of failing to investigate "unlawful acts" by Mayor Don Williamson, which include establishing a city-run impound lot.

Nelson joins Council President Darryl Buchanan as the second council member to face a recall attempt. Buchanan is appealing a Genesee County Election Commission decision that approved a recall petition filed by activist Eric Mays.

The election commission will consider approving Hardy's recall ballot language at 11 a.m. July 25. If approved, Hardy would have 180 days to collect enough signatures from 3rd Ward residents supporting a recall vote.

Nelson also is accused of failing to investigate why the mayor has not appointed a permanent police chief. Hardy also faulted Nelson for voting against a budget request by Clerk Inez Brown to hire a council secretary in February.

Meanwhile, Nelson has asked a Genesee Circuit Court judge to issue a restraining order against Mays, court records show.

Nelson applied for a restraining order Friday, four days after the councilman and Mays were involved in a confrontation at City Hall.

Mays had a loud confrontation with Nelson after the councilman refused to approve a transfer of a liquor license.

Mays was representing a woman who was involved in the liquor license issue and he was upset by Nelson's refusal. The confrontation started in the council chambers and continued outside the council office on the third floor of City Hall.

"He said he was going to get me if it was the last thing he does," Nelson wrote in his personal protection order application."

Judge Joseph J. Farah has not ruled on the request.

The confrontation was the latest incident involving the two, according to court records.

Last month, Mays went to Nelson's office at Citizens Bank and asked about the liquor license, court records show. Nelson accused him of creating a public disturbance and Mays was asked to leave and not return.

residents are complaining... Kerry Nelson does not respond to constituents!!
He CAN take the other recall efforts with a grain of salt. He better look to the people he is paid and elected to represent. They truly are tired of No Council after the last one! He better put up or get out!
