Flint man gets prison time for 2005 retaliatory shooting death

FLINT, MI -- A Flint man has been sentenced to prison for a retaliatory shooting that killed a 19-year-old Flint man in 2005.

Jamel Donte Cheeks, 27, was sentenced Monday, June 24 to 15-30 years in prison by Genesee Circuit Judge Judith A. Fullerton after pleading guilty to second-degree murder for the death of Jerrell L. Mays. He was also sentenced to serve a consecutive two-year prison term for felony firearms.

Cheeks initially faced multiple charges, including conspiracy to commit first-degree murder, first-degree murder, assault with intent to murder, discharging a firearm from a vehicle, carrying a concealed weapon and felony firearms. He could have faced up to life in prison.


Mays was found dead in a driveway at 3622 Kleinpell St. about 12:20 a.m. June 22, 2005, according to MLive-Flint Journal records. A second victim, Demerio D. Bonds was also treated for a gunshot wound to the lower right leg at Hurley Medical Center.

Both men were shot with a 7.62mm assault rifle, police said.

Cheeks' attorney, Michael Breczinski, said Mays was killed in retaliation for a 2003 incident that left Cheeks shot.

Bonds and Rodney Frisby Jr. are charged with assault with intent to murder for the 2003 shooting of Cheeks. Charges against the three were announced earlier this year as part of the continued investigation in the alleged Howard Boys gang.

Authorities say the Howard Boys used violence to control a territorial drug operation on the city's south side since 2002.

Cheeks is currently serving an 18 month to 22 year, 6 month prison sentence at Bellamy Creek Correctional Facility after pleading guilty to second-degree home invasion in 2008. He was also previously convicted of drug and gun charges.

Details Authorities say Oldham killed Malachi Wilson June 15, 2009, at Howard Estates. Wilson was killed after a love triangle involving his brother, his brother's girlfriend and Leon Gills erupted in gunfire, prosecutors said. Prosecutors told jurors that Wilson's brother found Leon Gills in bed with his girlfriend. Wilson's brother responded by pulling a gun on Gills but eventually left the apartment where he discovered the two. Gills allegedly later responded by firing multiple shots into a van that Wilson's brother was known to drive. Wilson's brother was not in the van, but two of the four people who were in the vehicle suffered gunshot wounds. Prosecutors said Gills then allegedly called Wilson's brother to tell him that he was the intended target of the shooting and that he planned to next target Wilson. Three months later, Wilson was gunned down by Johnathan Oldham and Shawn Gardner in the middle of Lapeer Road.

Oldham was also accused of attempting to kill a second person, Efram Anderson, Feb. 13, 2010, at the Boogie Down Motorcycle Club during a dispute with a member of the Drifters Motorcycle Club.

Authorities also claimed that he attempted to kill Charles Orr, another alleged Howard Boys member, July 22, 2009, after Orr allegedly killed Johnathan Oldham's brother.

FLINT, MI -- A former Genesee County inmate testified that an accused member of the Howard Boys gang admitted to a 2012 Easter Sunday double homicide while the two were in jail together.

The witness testified during a Wednesday, Sept. 25, preliminary exam that Markus Evans admitted while the two men were in the Genesee County Jail's recreation area to shooting and killing a man on Easter 2012. The witness also testified that Evans told him a man named "Rod" shot and killed a woman at the same time.

Evans and Roderick Jackson are charged with two counts of first-degree murder, first-degree home invasion, felon in possession of a firearm and felony firearms in the April 8, 2012, killings of Michael Edwards and Latosha Fox at Edwards' Neilson Street home.

Autopsy reports show that Edwards died as a result of multiple gunshot wounds while Fox died from a gunshot wound to the head.

The jailhouse witness is currently serving time in prison on 2012 convictions of unlawfully driving away an automobile and third-degree fleeing a police officer and a 2013 federal conviction of being a felon in possession of a firearm, according to state and federal records.

A neighbor at the scene told The Flint Journal previously that suspects shouted "Police!" before entering the home and killing the two.

"I seen the lights flashing from the gunshots," said Scott Stamper. "There were like nine or 10 shots. There was a shootout going on in there."

After hearing the gunshots, Stamper said he saw a man stumble into a Crown Victoria that looked similar to a police vehicle. The vehicle then sped away.

Evans, 25, and Jackson, 27, were stopped by Genesee Township police following the incident, former Flint police Detective Michael Angus testified.

Jackson was charged locally and Evans was named in a May 2012 federal indictment following a multi-year investigation by local, state and federal authorities into the alleged Howard Boys street gang, which authorities said used violence to preserve a drug and gun trafficking operation on the city's south side for the past decade.

Evans was sentenced to 16 years, 8 months in federal prison in a judgment signed July 1 by Flint U.S. District Judge Mark A. Goldsmith. He pleaded guilty Feb. 5 to one count of participating in a racketeering conspiracy for his role in the Howard Boys gang.

He had previous convictions of possession of less than 25 grams of cocaine and attempted carrying a concealed weapon.

Jackson was sentenced Tuesday, Sept. 24, to 4 years, 9 months to 10 years in prison by Genesee Circuit Judge Judith Fullerton after pleading guilty to assault with harm less than murder. He will also serve a consecutive two-year prison sentence for felony firearms.

The exam on the murder charges for the two men is scheduled to continue Oct.
18.
State records show Jackson has an extensive criminal history, including serving time in prison for assault with harm less than murder, felony firearms, delivery of less than 50 grams of cocaine and felony firearms. He was last paroled Nov. 29, 2011.

Details Holmes pleaded no contest to second-degree murder for the May 27, 2010, killing of Marcus Bishop. Bishop was shot multiple times in the head at the home at 6714 Eastmount Drive -- a known drug house.

He is also serving prison time after he and Shawn Gardner were accused of following Lennon Johnson Jr., 20, out of a club on Clio Road the night he was shot in 2009. Gardner allegedly fired shots from an assault rifle at Johnson during a car chase. Johnson was shot in the head inside his car and was then hit by oncoming traffic as his vehicle entered the intersection of Pierson and Kermit roads.

FLINT, MI -- A Flint man was sentenced to additional time in prison for his role in a fatal 2010 shooting at a known drug house.

Ricco D. Holmes, 30, of Flint, was sentenced Wednesday, Oct. 17, to 6-15 years in prison by Genesee Circuit Judge Archie Hayman after pleading no contest to second-degree murder for the May 27, 2010, killing of Marcus Bishop. Holmes was also ordered to serve a two-year consecutive prison term for felony firearms.

Bishop was shot multiple times in the head at the home at 6714 Eastmount Drive.

Holmes was charged with the killing in September 2012. Former Flint Police Sgt. Mike Angus said the charges were issued after following up on tips and information he obtained during his investigation into the Howard Boys gang. Holmes is not a member of the Howard Boys gang, Angus said.

The sentences will run consecutively to time that Holmes is already serving in prison, according to court records.

Holmes is currently serving 7 years, 2 months to 15 years at the Saginaw Correctional Facility in Freeland after pleading guilty in 2011 to second-degree murder for the death of Lennon Johnson Jr. He was also sentenced to serve two years for felony firearms.

Holmes has an extensive criminal history, including serving prison time for: breaking and entering a vehicle with damage, carrying a concealed weapon, felon in possession of a firearm and possession of less than 25 gram of cocaine.

Bishop, a 2002 Westwood Heights graduate, loved to cook, listen to music and play video games, previously said his mother Dorothy Crowder.

He had taken classes at Mott Community College, said Crowder, who Bishop lived with.

Bishop was Crowder's youngest child and he loved spending time with his two nephews and three nieces, she said.

FLINT, MI -- A 24-year-old Flint man has been sentenced to prison for a 2010 shooting at an area apartment complex that left one man dead.

Roderick Jose Dudley was sentenced to 8-15 years in prison Monday by Genesee Circuit Judge Judith Fullerton after he pleaded guilty to manslaughter. He will also serve a two-year sentence for felony firearms which will run consecutive to the manslaughter sentence.
Dudley was initially charged with first-degree premeditated murder and felony firearms after 20-year-old Dominick Barney was found shot to death in the hallway of a Lapeer Gardens apartment building on Lapeer Road near S. Dort Highway in October 2010.

Police testified during a preliminary exam that Dudley admitted to shooting at Barney.

Dudley told police that he and Barney had verbal altercations prior to the shooting.

Flint police Sgt. Mike Angus testified that Dudley feared that Barney may have been reaching for a gun and that Dudley opened fire because he felt threatened.

A final shot was fired nearly 10 seconds after the initial shots as Barney retreated up a flight of stairs at the apartment complex, according to court records.

Dudley's plea agreement also requires that he testify against a second man, Jonathan Walker, who authorities say gave Dudley the gun that was used in the shooting.

Walker's case was turned over to federal authorities, according to Genesee County Special Assistant Prosecuting Attorney John Potbury.

He was indicted on federal felon in possession of firearms charges in March 2011.

However, court records show authorities consolidated that case after Walker was indicted as an alleged member of the Howard Boys, a gang that authorities say used violence to control the gun and drug trade on the city's south side, earlier this year.

Walker has pleaded not guilty to charges of racketeering and committing murder in support of racketeering.

Authorities allege Walker, and his brother, Jatimothy Walker, gunned down Marion Hardy, 19, on Aug. 1, 2006, at the Howard Estates housing complex.


The case is ongoing in Flint federal district court.
