About a year ago, The city of Flint found out it will not have to pay a $1.1 million penalty for the long overdue housing development.

According to published reports, the federal government has agreed to waive the fine under several conditions.

The Flint Journal reported the city must build at least 83 houses, half of them for low- and moderate-income families, dedicate the resources necessary to complete the project, "including effective coordination among city agencies and priority for city approval processes" and "give priority to the Smith Village neighborhood for the commitment of available city resources."

The U.S. Department of Housing and Urban development originally asked for a repayment of a $1,086,935 grant, saying Flint did not meet federal deadlines on the Smith Village portion of the project.

Settlement agreement signed, families to move in at Smith Village

(09/26/12) - Flint's Smith Village is finally on track to move forward.

That from Emergency Financial Manager Ed Kurtz Wednesday as he outlined recent progress, which includes a settlement with the former developer.

The Smith Village project, on Flint's northside, has long promised affordable housing for low income individuals.

But there's been delay after delay after delay.

Most recent? Legal delays.

The former developer had the deeds, Kurtz says, and he wasn't going to hand them over until he got paid.

A settlement, for about $600,000, has been signed, and all related lawsuits have been dropped, according to Kurtz.

"It's gone wrong for 12 years," Kurtz says. "We need to move on. We talk about Smith Village every day. Several times."

Kurtz says 11 families have signed purchase agreements and those homes are the top priority for completion to allow for move in as soon as possible.

The city says only one interested buyer has dropped out because of the delays.

Kurtz says Smith Village's new developer has assumed all responsibility for marketing and selling future homes.

"In addition to that, we have one guy who is going to be supervising, for us, that whole project," Kurtz said.

Phase II of construction is scheduled to be completed, with the exception of landscaping, by the end of February.

That includes nine new homes, Kurtz says, plus five that need to be finished from Phase I.

There will be 39 homes total when Phase II is finished.

Phase II includes tearing up streets and putting in the necessary infrastructure.

About $900,000 was used from Flint's water and sewer fund.

The rest was grant eligible, Kurtz says.

Kurtz says the settlement agreement, with the former developer to pay himself and subcontractors, was almost all paid for by HUD.

About $60,000 came from Flint's general fund, Kurtz says.

Kurtz says the city should know, within weeks, when the first families will be moving in.

Did Kurtz tell channel 12 more than he told the Flint Journal?

Were the subcontractors paid?

Is there any marketing money left? The city awarded contracts exceeding the budgeted amount.

The family that left did so because their house was stripped of metal and they no longer felt safe.

Developer Agreement to Amend Exhibit A
The American Recovery and Reinvestment Act (ARRA) of 2009 was
approved by Congress on February 17, 2009 and Public law 111-005 approved funds for the Neighborhood Stabilization program 2 for the overall purpose of assisting in the redevelopment of abandoned or foreclosed homes under ARRA, The Michigan State Housing Development Authority (MSHDA) applied for and was awarded funding and allocated $15,772,344 to the City of Flint to fund NSP2 eligible activities and costs associated with the stabilization and redevelopment of the eligible census tracts. The
MSHDA NSP2 Consortium Funding Agreement NO. N52-2009-0049 for Flint NSP2 spells out the uses of NSP2 funds for Flint.

Resolution No. 201 2EM330 adopted June 20, 2012 approved the City entering into a development agreement between GDC Smith Village LLC for the construction of seventeen single family homes in phase II of the Smith Village development Exhibit A of the agreement contains the scope and overall project budget.

The parties have now determined that it is not feasible to commence construction of all seventeen homes, but have agreed to construct nine such homes. If feasible, additional homes shall be constructed by the developer using proceeds from the sale of the original nine. The parties have also agreed to an increase in the developer fee, not to exceed the allowable NSP limit on a particular unit if there are cost savings on that unit after construction.

IT IS RESOLVED, that the appropriate City officials are hereby authorized to do all things necessary to enter into an amendment with GDC Smith Village L.L.C. to amend Exhibit A, reducing the number of homes constructed in phase II from 16 to 9 and increasing the developer fee, not to exceed the allowable NSP limit on a particular unit if there are cost savings on that unit after construction.

Construction moving forward at Flint's Smith Village

(11/19/12) - Construction is moving forward again at Flint's Smith Village. City leaders say families could begin moving in soon.

Nearly a year ago, home buyers in Flint's Smith Village development were waiting for the go-ahead to move in.

But 2012 brought several set backs - including a change of developers.

Now the project appears to be back on track.

"We really appreciate their patience. I think we're very fortunate that they're still interested in buying," said Tracy Atkinson, of Community & Economic Development.

Construction crews are back to work and progress is being made.

Workers for the current developer, Ginosko, are currently tearing up the concrete porches. The porches need to be re-done so they're up to code with the Michigan Housing Development Authority.

City officials are confident in Ginosko's ability to complete the project, which has been 12 years in the making.

"They've done several MSHDA projects, so they are highly qualified developers," Atkinson said.

The hope is to have the first nine families in by Christmas, but that's not a done deal.

"Mostly what we've got are expressions of urgency. When can we get in? It's still very difficult to still not be able to give them a specific move in date because you don't want to give them a date we miss," Atkinson said.

Phase two construction is underway as well. That could be done by February.

Who is responsible for the porches that must be rebuilt?

Was the Project Manager negligent?

Was Operation Unification and their partner paid for this shoddy work?

Who selects the contractors under the section 3 agreement? Are there special favors for council or other administrators to qualify these sub-contractors as I have not seen ads for their recruitment. Other contractors are complaining they are being brushed off when they inquire about jobs,

How much money has been mispent or misused that they had to cut 8 homes from construction? Where is HUD or they part of a cover up/

It is amazing how many times money has been allocated for marketing when there was only an $80,000 budget originally.

Money was set aside from OU settlement to make various "corrections"

Project manager was negligent along with Champion who built houses using their specs from factory setup.

Rhode Construction in Grand Rapids who is the true contractor, Ginoko is just a money line for Brown's buddies who have done work with his "friends" in Lansing & are minority owned.
They have only hired 1 Sec 3 contractor Walker then let him go "due to slow work rate"
There are no Sec 3 workers on site and have not been since project restarted months ago. FACT, ask CDC for certified payroll records if you don't believe me. Rhode has no intention of hiring any.
Rhode has told several local workers that the job is not Sec 3 nor Prevailing wage, LIE.
Tracy & the City are aware and have done nothing.
Rhode has at least 40 worker on site from GR there.
There is no way now that HUD Sec 3 requirements will be met now.
NO 25% Sec 3 contractors
NO 30% of workers
NO 30% of contract monetarily
It is impossible at this stage even if every drop of work to be completed is done by Sec 3 workers and/ or sub/ contractors

HUD is not part of the cover up, the City lies to them, even face to face. Fine will be coming and everyone will act dumb & hope that finally completing the project is going to be enough to make HUD look the other way.

Uptown/ Mott/ Ridgeway will bail the City out when sales are nonexistent after a year and take over the property management of the subdivision which is the "secret" plan, hence their great involvement on even the type of units to be built. Some multi-units are in discussions also.

The original plan called for a 50 unit apartment structure.

I have considered writing to leader in the federal government on housing to address the high level of incompetance and corruption that has occurred with this project. Goveror Snyder and his cohorts may be the most corrupt yet. The Judge who ruled on the council lawsuit stated the state needed "more time". My question is whether they need more time to strip our last resources.

The Manta small business registry showed a Rhode Construction located at 450 N. center Dr. NW in Grand Rapids Michigan.

This company, established in 2005 was shown with 1 employee and was not one of the top 5 home builders in Grand Rapids. The MIchigan Secretary of State does not show a corporation by this name nor is there a builders license under this name or under the individual name of Rhode.

The correct spelling of the new construction company is Rohde and not Rhode. This is their project summary of Smith Village.




Smith Village

Smith Village is the revitalization of an existing neighborhood in Flint Michigan through the construction of 39 new homes. Rohde’s involvement in the project is the construction of new homes in phase 2 and the completion of homes left unfinished by a previous contractor in phase 1. This is a scattered site project with the added complexity of building new homes directly adjacent to existing homes spread across an area of several city blocks.
