I am told that at least 2 contractors are owed money- Kennedy ($120,000 to $150,000) and S L Walker (about $80,000).

This language included in the bid is important as it mirrors the Michigan Home Rule Act.

The Director shall not knowingly accept the bid of a vendor /contractor who is in default on the
payment of taxes, licenses, fees or other monies due the City. Purchase agreements with bidder
who are found to have been in default at the time of award of süàh agreement shall be voided.

Lawler complained about infrastructure and stated the money was there for the infrastructure. This resolution 2012 EM 233 atates the infrastructure was halted because of need to locate a new funding source to complete the infrastructure.

So does this mean that Walling and Eason (and heads of DCED) dis not adequately plan for the infrastructure of this new development?

This contract for $594,567.90 is the balance required after the water and sewer funds from Flint were used. Lawler should get more information.

The City has identified that $805,929.72 is necessary for infrastructure improvements on Avenue A, Root,
Chippewa, and Wood Streets in the Smith Village neighborhood. The work is to be completed by a combination
of contractors and city crews. These infrastructure funds are necessary to support the new housing development
currently underway.
The City previously bid out the work and selected DiPonio Contracting, Inc. to install the infrastructure. DiPonio
Contracting has completed some of the infrastructure work utilizing water and sewer funds. Work was stopped
until additional funding was identified.
The City of Flint allocated Community Development Block Grant funds in its 2011-12 Action Plan of the
Consolidated Plan for the Smith Village infrastructure project.
A new contract is necessary for the work that will now be completed utilizing Community Development Block
Grant funds.
Funds for the Smith Village infrastructure project are set aside in revenue account number 272-748.181-502.748
and expense account number 272-748.181-805.101.
IT IS RESOLVED, that City of Flint officials are authorized to do all things necessary to enter into a contract
with DiPonio Contracting, Inc. in an amount not to exceed $594,567.90 for infrastructure work in the Smith
Village neighborhood with funds to be made available in revenue account 272-748.181-502.748 and expense
account number 272-748.181-805.101.

Lawler should have seen the writing on the wall with this resolution. In the original documents the City was to work with the developer on a marketing plan director. The City expended huge amounts of advertising in the CPSA Courier as part of a marketing expense and there were other marketing tools used.

Budget wise I am not sure if this $80,000 still exists. Without council meetings where council, especially Kincaid and Freeman, can address these budget issues we the citizens are left in the dark.

Has any expenditures been disallowed by MSHDA, as they are the pass through for the federal funds. What communications has there been in reference to Flint not meeting the established criteria for this grant funding?

The American Recovery and Reinvestment Act (ARRA) of 2009 was approved by Congress
on February 17, 2009 and Public Law 111-005 approved funds for the Neighborhood
Stabilization Program 2 for the overall purpose of assisting in the redevelopment of
abandoned or foreclosed homes under ARRA;
MSHDA applied for and was awarded funding and allocated $15,772,344 to the City of Flint
to fund NSP2 Eligible Activities and Costs associated with the stabilization and
redevelopment of the eligible census tracts; and
The MSHDA NSP2 Consortium Funding Agreement No.: NS2-2009-0049 for Flint NSP2
spells out the use of NSP2 funds for Flint; and
Funds are to be made available in expense account number 297-743.100-502.743

Channel 12 reported at 5 p,m and 6 pm that over 12 contractors have not been paid for their work in Smith Village. The representative from Kennedy Excavating would only say they had not been paid for half of their contract. He stated the contracors were over their head and did not know what they were doing.

The representative of DF flooring said at first the contracts and terms of payments seemed legitimate and the company was pleased to get the work. However, when payments were not forthcoming according to the contractual terms, she was concerned. The company is owed $54,000 and the owner has absorbed the costs so far because they wanted to be fair to their employees.

Contractor leins have been placed on the homes, which cannot be sold until the leins are satisfied.

Oddly the subcontractors kept referring to SE Metro Properties and Charles Young. The entity created to do the the development is Smith Village Construction. SE Metro Properties is Bret Russell out of the Detroit area.

Young in a phone conversation blamed Brown for the delays stating he did not know who had final approval for payment. Oddly there were no pending payments shown for Smith village Construction.

Money was paid as recently as March 12, 2012 and yet the subcontractors were not paid. Brown took office on Dec 1,2011 and Smith Village got 5 payments after that date. So why blame Brown? Who got the money?

Russel Building Group was not the developer. i wonder if Champion was paid? Russell was pulling permits under a variety of names, some which did not exist. Russell had his builders license for less than a year when they got the contract. Poor performance on the city's part.

Shouldn't the feds be looking for the money trail and possible kickbacks?

Lawler should have checked all of the facts before he went public.

Affordable living and neighborhood amenities bring families back to city

TROY, Mich. – Oct. 13, 2011 – Champion Commercial Structures, a division of Champion Home Builders, a leading manufacturer of modular homes and buildings for government and commercial applications, today announced in partnership with Russell Building Group that the company will build a series of 83 homes as part of Flint, Mich.’s Smith Village Neighborhood. The Smith Village an urban redevelopment project is intended to integrate low and moderate income homebuyers without a noticeable difference in quality and design.

The project, funded by a U.S. Department of Housing and Urban Development (HUD) grant, broke ground in July. The first phase is slated for completion Dec. 31, 2011 and will consist of 27 homes built offsite and transported to the development. Champion will begin to deliver the first phase of homes on Oct. 17, 2011. The homes will be assembled onsite, with the basements, garages, porches, exterior facades, including all siding and brick work, roofing and mechanical systems completed by local workers and contractors.

“Smith Village is an exciting project for Champion Home Builders,” said Jack Lawless, CEO, Champion Home Builders. “With the first phase deadline approaching time is a major factor and we have the ability to build and deliver the homes quickly for onsite finishing. Our modular building process also assists with keeping the cost of labor and materials within the project’s budget. As a Michigan-owned and -operated company since 1953, we are pleased to be part of this redevelopment effort.”

Smith Village will consist of seven custom Champion home designs, which range from approximately 1,500 to more than 2,000 square feet. Designs include a mix of three and four bedroom layouts, and each includes a large master bedroom with walk-in closets and a minimum of two full baths. Homes will be finished with amenities such as energy star appliances, “low e” vinyl windows, energy efficient heating and air-conditioning systems, and ceramic tile floors.

“For Flint to succeed in revitalizing its urban landscape and rebuilding its civic spirit, it’s imperative to bring families back to the city,” said Bret Russell, CEO, Russell Building Group. “The homes Champion and Russell Building Group are building for Smith Village will provide comfortable, affordable and safe places for families to grow and thrive in Flint.”

Beginning in 1998, the City of Flint began acquiring property through a series of tax foreclosures to develop Smith Village into a model urban neighborhood boasting tree lined streets, sidewalks, underground utilities and decorative streetlights. Over 200 blighted structures were demolished to make way for the community. In addition, through the past six years, the City of Flint and its partners have demolished over 2,000 dilapidated homes throughout the community to remove blight and improve overall neighborhood conditions. Additional targeted demolition will continue over the next several years. This effort has positively affected home values in Flint, with the average cost of housing up 13 percent in 2010.

Smith Village will most likely not be completed by next March. What does that mean for us in the form of paybacks to HUD.

I spoke to Tony Martin, the Flint HUD agent. He would only shake his head grimly and say yes when I asked him if HUD was concerned over Smith Village.

They should be and so should everyone in Flint. This payback could have been prevented without building Smith Village.

The State, through MHSDA , gave the majority of NSP2 dollars to Flint and Genesee County Land bank for Smith Village.

The changes cames from Walling and Eason. Besides the 3 stages of development and 83 houses in Smith Village, Flint is on the hook for much more. Eason told HUD Flint would pay for all streets, sidewalks, landscaping, trees and a small park. In addition we must build a Early Childhood Development Center and a Center for the Performing Arts.

This comes as part of the survey taken by downtown groups who claim the downtown area needs 500 new houses.

If anyone saw the article on the Land Bank tour, then you know the Land bank renovated 25 homes and only sold 5. Kurtz recently changed the status of the Salem Housing homes from rent-to-own to rentals because of the HUD audit citing Flint and salem for their inability to sell these homes.

In the meantime I am seeing individuals buying vandalized homes and restoring them to live in or rent. Are private investors so bad when tthey are not using public money?

Kurtz: Construction set to resume in Flint's Smith Village

FLINT, MI -- The city of Flint says work is resuming in the Smith Village housing development after delays that kept some would-be residents from moving into their homes.

Emergency financial manager Ed Kurtz said the new developer hired by the city has received the deeds to the 25 houses that are currently at the site, and can begin getting the homes ready for occupancy.

The new developer, Ginosko Development Co., was recommended by the Michigan State Housing Development Authority, Kurtz said.

"We spent yesterday walking through the first 11 houses we have purchase agreements on," Kurtz said this afternoon at a news conference. "We made a detailed list of everything that needs to be done to get occupancy permits."

Potential Smith Village residents have recently raised concerns that their houses still are not finished. Some have been waiting to move in for nearly a year.

Kurtz said the city signed a settlement agreement with the previous developer, Smith Village Construction Services, who was let go in May and later filed a lawsuit against the city.

Kurtz said he didn't have the details of the settlement immediately available at the news conference, but said it amounted to about a $600,000 payment to the previous developer in exchange for the deeds to the houses already built .

The attorney for the previous developer could not immediately be reached for comment Wednesday.

Kurtz said the city is hoping to have 39 houses built before the end of February. All told, the city must complete a total of 83 homes, with at least half for low-income residents.

Eleven buyers have signed purchase agreements for Smith Village homes, he said.

The project is being funded mostly by federal Neighborhood Stabilization Program funds, officials said. About $900,000 from the city's water and sewer fund went toward infrastructure at the site, Kurtz said.

The project started in 1998 with funding from the U.S. Department of Housing and Development, but has stalled throughout the years. The city must complete the project or risk a $1.1 million penalty from HUD, according to a letter sent in September 2011 .

Is this in addition to the CDBG (Community Block Development Grants from HUD) funds allocated to Smith Village?

is this part of the higher water bills we pay?
