The State of Michigan, through the (MSHDA) Michigan State Housing Development Authority, distributed the Neighborhood Stabilization Program 2 (NSP 2) funds to cities in MIchigan. A recent audit by the Office of Inspector General (OIG) revealed that 8 cities had improperly used these funds and the state was subject to nearly a million dollar repayment.

Flint at that time was not part of the audit. Recently a Freedom of Information Act (FOIA) request was sent to HUD for the recently released monitoring reports for NSP 1 and NSP 2 as well as communications between the City of Flint and HUD regarding the NSP1 and NSP 2. Also requested was the contract for NSP 3 of which it is said had significant restrictions.

Hud who had freely responded to previous requests, suddenly became difficult and demanded nearly $1400 for the request. After a group of media people discussed this issue at the White Horse during a luncheon, it was agreed that this was a reaction to a possible investigation. The FOIA
was replaced for a less intrusive FOIA. HUD was informed that Eason had publicly stated that HUD was to blame for the city"s HUD issues.

I was told yesterday morning that State of Michigan vehicles were all over the City of Flint. Good work MIKE!

City of Flint officials have said nothing about it, but Crusader News Service has learned from reliable sources that officials from the State of Michigan have been at Flint City Hall to audit the books. Some suggest it's a sign of an impending state takeover or part of further investigation into possible criminal activity.

Flint Mayor Dayne Walling held a press conference in late May to say he was not a target of a criminal investigation after a Raid at Flint City Hall. The FBI and other federal investigators took away computers and files during the raid. Special Agent Robert McDonald of the FBI did not respond to a request for comment about the case from Crusader News Service.

This story on AM ADVANTAGE is so far the only media report about what sources say was a surprise visit by state officials. So, too, is another story about Monday night's "add-on" to the Flint City Council's agenda for a $9.9 million check for the Smith Village project. The same source who told Crusader News Service about the visit by state officials for an audit of the city's books had also told Crusader News Service on Saturday that the $9.9 million check for Smith Village would be an "add-on" to Monday's agenda and approved without discussion. "The gig is up for Mayor Dayne Walling's administration and they're passing out as much money as they can, as fast as they can, because they know a federal grand jury would not be here unless people are going to jail," said the source who would not reveal how he obtained his information.

Funding from a federal agency known as HUD is expected for the Smith Village project. It's proposed at $16 million with a $4.7 million return from the sale of homes. The new construction homes are expected to be sold for between $50,000 and $57,000. A requirement includes building 42 houses before the end of the year or the city may have to repay other grants previously obtained without projects ever being completed.

Another source speculated that an audit by state officials could be after a referral by the FBI about possible criminal activity that would be under the jurisdiciton of the State Attorney General's Office. Yet another source speculated that the audit could be to determine if the city's finances are in bad enough shape to require a state takeover.

Mayor Walling made an attempt to get a $20 million bailout earlier this year from the state, saying the city would not be able to make payroll without it by March. Walling didn't get the $20 million bond request, but mysteriously made payroll despite earlier claims by his administration that it could not happen without state help. The city later got $8 million from the state. Flint's finances showed a $17 million deficit after an audit by the accounting firm of Plante Moran earlier this year. Mayor Walling's budget that took effect for the current fiscal year that began on July 1 was adopted after amendments by the Flint City Council to prevent the mayor's proposed elimination of funding for the city's ombudsman office and the city's human services commission. Both departments are mandated by the Flint City Charter. Critics pointed out, however, that achieveing a balanced budget depends on getting more funding from state revenue sharing and getting the city's public safety unions to accept concessions.

A contingent of six speakers from the Flint Area Chamber of Commerce opposed the $20 million bailout during hearings by the finance committee of the State Administrative Board. The proposal was passed on to the full State Administrative Board by an unanimous vote, but was then pulled off the agenda by Governor Rick Snyder after a visit to Genesee County a few days earlier by his Lieutenanat Governor, Brian Calley. He met unanimous opposition at a Grand Blanc meeting of prominent business leaders from Genesee County.

Pat Clawson, a former investigative reporter for CCN and NBC News, represented the Chamber's position at the final meeting before the State Administrative Board. He argued that the bond proposal by Mayor Walling's staff was a "dump of toxic waste on the public" and argued that serious concerns should be investigated about the city's ability to pay back the loan. Clawson called Walling the "bag man" in a Minneapolis public corruption scandal that included a long-time city councilman getting a 30-year prison sentence. Clawson said he had experience with "bond worthiness" as a private investigator and demanded that Walling's lack of business experience and past record were "critical items" to consider when putting the state's taxpayers at risk for the bonds.

Mayor Walling never responded to Clawson's claims, but he routinely does not return telephone calls or respond to visits to his office for comments from FAME NEWSPAPERS, AM ADVANTAGE or Crusader News Service. This practice began after a story were published in May 2010 that revealed an investigation by FAME NEWSPAPERS into alleged widespread public corruption within Flint's city government. A break-in at the offices of FAME NEWSPAPERS occurred on the weekend after the story was published. Nothing was taken in the break-in except a drawer filled with documents related to investigations into public corruption.

Mayor Walling did defend himself in regard to the Minneapolis scandal, telling members of the East Side Business Association last month that he cooperated with the FBI and "will always do the right thing." Walling talked briefly about the incident for the first time after the question was raised by Dan Parks, who was chairman of the Committee to Recall Dayne Walling. Parks led a group that merged with four others to gather 22,000 signatures from voters who wanted Walling ousted. The city's clerk (Inez Brown) and the county's clerk (Michael Carr) combined to disqualify just enough signatures to keep the recall question off the November 2010 ballot. A lawsuit to get a temporary injunction then failed in federal court after Parks and his group provided evidence to show they had enough valid signatures. Parks said the lawsuit was dropped because it made no sense to wait until February 2011 for a recall election when the August primary was so close to that date.

About 4,800 signatures were also stolen with a police officer's laptop computer during a break-in at the recall group's headquarters, which was at an office building in Downtown Flint operated by Tri-County Publishing, a division of eToday Inc. that also owns AM ADVANTAGE, FAME NEWSPAPERS and Crusader News Service. An arson last month destroyed the office building.

"That building has been vacant for some time. After the building had been vacated, doors were left open, there was a gas leak and police and fire department and Consumers were called out. There's an abandoned vehicle on the property, garage with roof falling in and doors falling off, not to mention dead trees along the property line and fence falling down."

The fire at 801 caused damage to buildings on both sides. And just before B2B weekend the vacant apartment building around the corner was burned down. The office building on the corner adjacent to that one will probably be next.

That building was being used until repeated breakins and vandalism. It is my understanding there was an effort underway to remodel the building. The odd thing is that the city swooped in and started to bulldoze the building while it was still smoldering and the arson squad never got a chance to investigate. I was told the city employee on the dozer is not shown as working for the city on that date!

Part of the building was used in the recall of Walling effort.

FLINT, Michigan — A preliminary review of Flint's finances could take up to 30 days to complete, according to the revised emergency financial manager law.

After the state treasurer's office finishes the preliminary review, the governor can then appoint a review team for a more in-depth look at the city's books "if a finding of probable financial stress" is made.

Flint Mayor Dayne Walling announced today that the state will begin a preliminary financial review in Flint on Monday.

"It can end in a variety of ways," said Terry Stanton, spokesman for the state treasurer's office. "It doesn't mean an emergency manager would be appointed."

The review team would then report its findings to the governor, who has several options, including granting a consent agreement between the state and city officials on a plan to resolve any severe financial problems.

Under a consent agreement, a local government official would be given expanded powers. The law says the local government also would not be subject to "collective bargaining requirements" after 30 days for expired contracts.

The city's four public safety contracts are currently expired. Existing contracts would not be affected.

The governor could also start the process toward a state takeover of the city’s finances — which would turn the operation of the city over to an emergency financial manager.

But Stanton said the law is intended to prevent communities from falling under a state takeover.

"(The law was revised) in order to provide local units better opportunities to address issues early on and so that the state could step in sooner," he said.

FLINT, Michigan — Michigan Democratic Party Chairman Mark Brewer decried a preliminary financial review in Flint as an "attack" on Flint's elected leadership by Gov. Rick Snyder's administration.

Brewer issued a statement this afternoon following Flint Mayor Dayne Walling's announcement today that the state treasurer's office will begin a review on Monday.

Here is an excerpt of the statement:


"Let me be crystal clear on what's happened in Flint today. This financial review is a direct result of the Snyder administration's attack on our urban areas as well as his failed jobs policies...



"Mayor Walling along with the Flint City Council and Flint's public employee unions, especially AFSCME as well as other city stakeholders, have taken aggressive action over the last two years to deal with the economic pressures put on their budget...



"It's unfortunate that the Governor and State Treasurer have chosen to ignore this remarkable example of progress and cooperation only to insert themselves in an effort to attack Flint's elected leadership, hard-working public employees, and middle class families and usurp local control."


A spokesperson for Snyder's office could not immediately be reached for comment.

Terry Stanton, a spokesman for the state Department of Treasury, said the preliminary review was sparked by financial triggers outlined in the emergency financial manager law, also known as Public Act 4 of 2011.

Walling said treasury officials pointed to the city's year-after-year budget deficits as a primary reason for the review.

(08/26/11) - The state treasurer's office is stepping in, starting a preliminary review of Flint's finances.

Flint is the first city in Michigan to get to this step as part of the new emergency financial manager law.

The process could end a number of ways, including in a state takeover.

"One of the clauses in the law is any school district or municipality, with an audited deficit in an operating fund, is eligible under this law. The city of flint has qualified many years," Mayor Dayne Walling said as he announced the review.

Walling says the state initiated the review.

He says he was notified Friday afternoon, by letter, by the treasurer's office.

Walling says state officials are concerned about Flint's cash flow, multi-million dollar deficit and that the city is not in compliance with its former deficit elimination plan from the summer of 2009.

The review news, not unexpected, for Flint firefighters union president Raul Garcia.

"It was, just to me, a matter of time," Garcia said.

"I want to make clear that I'm optimistic about our ability to demonstrate the highest level of fiscal responsibility and stay in control of our community's future. It's time to prove to the state, once and for all, that we are prepared to address our long standing challenges. Now is not the time to turn back the clock and sweep our problems under the rug again," Walling said.

The state appointed a city financial manager, to control the city's nearly $40 million deficit, in the summer of 2002.

FLINT, Mich.— Michigan officials on Friday ordered a preliminary review of the city of Flint's finances, the start of a process that could lead to the state appointing an emergency manager unless city officials can get Flint's finances in order first.

The preliminary review is the first involving a Michigan city since the state revised its emergency manager law early this year.

Flint Mayor Dayne Walling said his office is "fully cooperating" with the review and is optimistic that the city can avoid getting a state-appointed emergency manager.

"I'm optimistic that the city of Flint will demonstrate the highest level of fiscal responsibility and stay in control of our community's future," Walling said.

The city of about 102,400 residents has been hit hard by Michigan's economic downturn. Walling said the city has made progress with its finances but needs to take more steps in that direction.

State Treasurer Andy Dillon ordered the preliminary financial review due to "several factors," Treasury spokesman Terry Stanton said. The review is scheduled to begin Monday and could take up to a month.

The city of Flint was authorized to issue $8 million in fiscal stabilization bonds in February. It now appears the money raised from that offering won't do as much to help the city's finances as originally expected, according to a letter sent from the state to Flint officials.

The letter said some steps the city committed to take to improve its finances, such as securing labor concessions, have not been implemented.

The revised Michigan emergency manager law includes more triggers that supporters say are designed to get financially troubled cities and schools the help they need to avoid a state takeover. The ordering of a preliminary review doesn't automatically mean a city or school will wind up with a state-appointed manager.

But the law has sparked controversy and court challenges because it gives broad new powers to emergency managers who are appointed, including the ability to strip local officials of power and toss out union contracts.

Gov. Rick Snyder has asked the Michigan Supreme Court to quickly resolve legal challenges to the revised law he signed in March.

Michigan has emergency managers in place in the Detroit public school system and the cities of Benton Harbor, Ecorse and Pontiac. The city of Highland Park's school district is in the pipeline to potentially get an emergency manager, with a state-ordered preliminary review of finances set for this month.

Friends are telling me that there are rumors that Walling has been named Modified Emergency Financial Manager.

I was busy today and just started making calls. The rumor mill is runnning rampant and many make no sense at all. The scariest rumor is that the city has a $35 million deficit.

What started as complaints by contractors that they were not being paid for work done in Smith Village now has evolved into stories that contractors have been told they would not be paid by Young. That makes sense only if they started work before the contract was signed. HUD does not pay for work done prior to a signed contract.
