'He was quite forceful,' prosecutor tells jury

Article Text:

Brad L. Lyon tried to kiss a physically challenged woman he was taking to see a movie in July, but she resisted, a prosecutor says.

While in his car at a Birch Run theater, Lyon - a Flint area semi-professional football player - grabbed the then 21-year-old woman by her hair and demanded that she perform oral sex on him while parked in a handicap spot, Saginaw County Assistant Prosecutor Paul M. Fehrman told a jury of four men and 10 women Thursday during Lyon's trial in Circuit Court.

"He was quite forceful," Fehrman told jurors. "She did what he said, but she was frightened."

When patrons starting walking toward Cinema Hollywood's entrance, 12280 Dixie, Lyon moved the car and again forced the woman, who has cerebral palsy, to perform a sex act on him, he said.

Prosecutors have charged Lyon, 23, of Flushing with one count of kidnapping and four counts of first-degree criminal sexual conduct against the Saginaw County woman July 19 in Birch Run Township.

Defense attorney Anthony P. Vance told the jury the woman consented.
However, she reported to authorities that Lyon forced himself on her.

Lyon, a fullback, remains jailed on a $90,000 cash or surety bond. He plays for the Genesee County Patriots, a minor league football team that is part of the North American Football League.

Lyon and the woman - a college student studying anthropology - met in an Internet chat room, Fehrman said.

Eventually they decided to see a movie, he said.

Lyon arrived at her house after the matinee started, so they decided to see a later showing.

After the first two sexual encounters outside the theater, Lyon told the woman not to tell anyone because no one would believe her and that he had friends in high places, Fehrman said.

Lyon then drove around, into Genesee County and then back to Saginaw County, he said.

They ended up at a church and he drove to the rear, Fehrman said. Lyon again forced the woman to perform a sex act, he said. This time, Lyon dragged the woman out of the car and forced himself on her, Fehrman said.

During the assault, a van pulled in and Lyon laid on top of the woman, nearly suffocating her, to keep her from calling out for help, he said.

Lyon became upset, put her back in the car, drove to a McDonald's restaurant to get food and then took her home, the prosecutor said.

After her mother asked several times what was wrong with her, the woman started crying and said Lyon had raped her, Fehrman said.

"She suffered terrible anguish and physical injury," he said.

Lyon and the woman - who initially gave him a false name - were on a blind date, said Vance, the defense attorney. It was her desire to fit in and she hid her illness from Lyon, he said.

Lyon was so flattered that someone was interested in him that he agreed to the date, Vance said. The woman often talked about sex when they communicated with each other, he said.

"She tried to win him over with sexual innuendoes," he said.

When they met for the date, Lyon discovered the woman had a physical disability but he decided to go anyway, even though he was uncomfortable, Vance said.

The sex acts the woman performed were consensual, he said.

When Lyon decided to end the date, the woman felt scorned, Vance said. "She knew there was not going to be a second date," he said.

Authorities did not find any DNA, body fluid or hair that matched Lyon after the alleged assault, Vance said, adding, "That's very important."

Lyon is his football team's vice president and director of operations, the squad's Web site shows. He helped found the team in 2002 with his father, Leo J. Lyon, who is the team's president and general manager.

The trial was to resume today.

Probably in a few years Michigan/Flint could become a porn capital with state tax dollars going to subsidize it. There's always "unintended consequenses" when you get "geniuses" like those in Lansing that want to be able to say they created a few thousand jobs even though we're losing more like a few hundred thousand.

It'll probably never ever happen again, but I agree with you, Adam, a million percent!

LakeWoman50, how did you find that out? To name a few - you mean there's others? They're supposed to start shooting this week, but everyone I know who's in the movie says they haven't heard a thing. Also, whatever happened top Pauly Shore? Someonme said he already pulled out of this scam.
