Per Riopelle Potter has no interest in the Holly Pointe Academy, but Delaney is one of the owners. Riopelle was unsure who called him Potter or Delaney to go out to Holly Pointe Academy but he believed Bill Delaney was in charge. Riopelle insisted any reimbursement of time would be between Delaney and Larry Parks of the Controller's Office.

Delaney had told Riopelle that knowing about the investigation, that he (Delaney) was reconsidering reimbursement . Delaney told Riopelle he did not believe he had done any thing wrong, but if there was a question, he would pay up. This occurred with a group that takes breaks outside the building (Riopelle, Delaney, Potter, Kirk Richardson and some others.

Hobson works for Riopelle and Chicutt worked for both Riopelle and the police. There was no attempt to adjust for the time they were away from the township for Holly Pointe Academy.

On April 8th of 2000, there were repairs on a water line at Warwick Pointe Academy. Waldorf Plumbing was called to repair the work. Township employees Dave Hobson and Brian Gleason worked there that day.

There was a problem with the leak that Waldorf could not handle. Dave Hobson called Brian Gleason to bring the township backhoe and they worked there for a period of time.

Riopelle and Delaney continued to talk about the investigation and Delaney believed he was being singled out.

Compeau stated that both Delaney and Dan Potter were at the water line break. Both received overtime pay.

Compeau asked if any attempt had been made to recover township funds spent on Delaney's schools.

Norm Riopelle: I...I've not made an attempt to recover the money just as I would not have made an attempt to recover the money if they were doing the exact same thing for a different resident.

If the township sends out the backhoe with an operator and the township was charging, the charge was $50 an hour per Riopelle. They have prices for a number of specialized pieces of equipment. to contractors. The equipment would not be rented out to a private citizen.

A sewer vac would be used for a private citizen at no charge. But if a contractor is putting in a new subdivision and in the process of installing the sewer and storm sewer some mud and dirt gets in and it needs to be cleaned. The township will charge the contractor for cleaning the line.

CAPTAIN COMPEAU INTERVIEW WITH KIRK FREDERICK RICHARDSON

Richardson was an 18 year employee of the township at the time of the interview (June 8, 2000)

Richardson told Compeau he went to the auction held in 1998 to buy a bike and had not told township officials he was going. Delaney was the auctioneer and police items were auctioned off first. Detective Rust and Detective Withim removed items from lockable conex boxes and placed them outside near Delaney to be auctioned off.

Richardson described how the township was remodeling and every employee including the detectives in the police department got new desks, furniture and work stations.

All of the old desks from their work stations were to be auctioned off. However the furniture was not individually tagged.

Words have power and the interviews speak to a Captain Compeau upset at how the close knit group of supervisors bend the truth and meet to spin the saga in Delany's favor. Witness after witness initially admits their conversations with Delaney and/or Norm Riopelle prior to the interview with Compeau. But when the re-interviews start under subpoena with Randy Petrides of the Prosecutor's office and Compeau, some of their defenses start to fall. Especially when Compeau hits them with issues they never saw coming.

That was especially true in the interviews with Dan Potter. Potter had been retained as a consultant on water and sewer issues for Grand Blanc Township since 1998. Although not a township employee or a supervisor, both Potter and several employees stated they take his orders.

Potter also works for Bill Delaney, but does not have a contract.

Compeau discussed the July 28, 1999 use of township employees and the township generator at Holly Academy in Oakland County.

Potter confirmed Riopelle, Hobson and Chilcutt were present at the site for at least 2 to 3 hours. The generator truck was needed to provide power to the construction crew. Potter confirmed that Bill Delaney owned the property the school occupied.

Potter danced around the issue of who ordered the generator truck to go to the site by claiming he did not recall. Only he and Delaney were present initially and yet he could not recall who told Riopelle to bring the truck.

While Potter repeatedly stated he was not the boss of any township employees, but if he requests something, it gets done. When asked why it would be an easy decision to bring in township equipment, Compeau asked why since Potter had no financial interest in the school and had no authority to call employees to the site.

Dan Potter: We were there tying to get a job done. If I know of a generator, if I know that Genesee County Water and Waste had a generator that they weren't using, that we could get down there, I would have called them.

Potter said he did not remember if he called or Delaney called. He also stated he did not believe it was improper to use Grand Blanc Township equipment in Oakland County.

Potter: It's a public school. We've been through this.

Compeau: So, under your analogy your'e in Oakland County at Holly School so someone called from Southfield and they needed Grand Blanc Townships tractor, you could just send employees down there, since it's a public school.

Potter: If its a governmental agency. We do inter-governmental work constantly.

Compeu: Okay, Dan, I think you know who called for that generator down there. I think that you know. I don't buy this that I don't know or someone had to make a decision. There's only two people there. There's you and Delaney.

Compeau moved on to the water meter leaking issue. Potter stated he had called Waldorf to fix the meter at Warwick Pointe Academy in Grand Blanc. Delaney gave him the key to let Waldorf in the building. He had company coming in town and asked Hobson to drop the key off on his way to work.

Potter stated he went to the site in the afternoon and Dave Hobson was there with two Waldorf employees. Potter insisted he did not know if Hobson was there on township time.

Waldorf had to dig by hand to try to find the leak as their equipment was working at another site with problems.

A decision was made to bring the township backhoe in, but once again Potter could not remember who made the decision.

He made the familiar excuse. There was a three-way conversation on the Nextell phones between Delaney, Potter, and Hobson. He says one of the three must have made the decision.

Compeau: .....When it comes down to decisions you seem to forget.

There was a testy discussion of the fact that the school sits on land owned by Bill Delaney.

Potter had temporary amnesia about a lot of township involvement.

Both Sgt. Shanlian and Capt. Compeau were present when Randy Petrides of the Genesee County Prosecutor's office interviewed Dan Potter a second time with his attorney Lee Carey present.

Potter stated he had been in a consulting capacity with Grand Blanc Township since April or May 1998. He had retired from Genesee County Water and Waste as a Chief of Operations and Maintenance.

Grand Blanc Township had a 75% water efficiency and they were losing money on their water system. His assistance was requested to raise those level. He only works on a part time basis , maybe 20 to 30 hours per week.

He also works consulting for Warwick Pointe LLC, which he believes is a holding company. He does not consult for the school. Bill Delaney recruited him after he began working for the township. His supervision or coordination contact was Bill Delaney and Norm Riopelle.

Potter was working at the Holly Pointe School as a consultant for Warwick Pointe LLC when the power for the construction crew was lost. Petrides asked the obvious question. Why didn't they rent a generator instead of using the generator truck from the township.

Potter: I'm not sure, In the township we knew there was uh uh generator there. We had loaned it to schools a number of schools in the past. We just called and got ????? the generator there

Petrides : In that conversation with Bill before the call was made to get the generator did Bill, since Bill I take it was the supervisor that he was the one that would have the say as to whether the township's generator would be the one sought.

Potter: Ultimately, yeah I guess so.

Capt. Compeau asked follow up questions regarding Dave Hobson and Norm Riopelle as supervisors in the two incidents they had. ......Are you a supervisor where you can tell them, give them (township employees) an order that they have to follow?

Potter: No

Compeau: Um. and I am going to ask the same question that Randy Petrides asked about the Holly Academy that Bill Delaney was the supervision and it would have been his decision to let you know okay the generator to go out there correct?

Potter: Ultimately it's his responsibility. I'm not sure if he made the decision to allow it. I mean we called there and talked to Norm or Dave I don't remember who and said is the generator out being used anywhere and they said no, and you know can you bring it down and that's.

Potter again continued to say he didn't who made the call to the township for the generator. But he did acknowledge that Delaney was aware of the use of township resources in both situations raised by Compeau.

Sgt. Shanlian took over the questioning and questioned Potter about the language of his contract with the township. Shanlian subsequently questioned Potter regarding his work as a contract employee of ABZ Environmental. Potter worked for ths company at the same time he worked for the township. The township checks were made out to ABZ Environmental, but sent to Potter at his home to be cashed. He also had power of attorney to pay other sub contractors.

Shanlian wanted to know if the area paid to Potter for township work involved the same tasks he was paid for by ABZ. Potter denied this and was questioned about purchases from the ABZ warehouse. Shanlian asked if the purchase was for an alarm

The purchase was for a monitoring system that monitors when a pumps are on or off or if there was a power failure or if a flood or sanitary sewer station goes down. It has nothing to do with water efficiency.

Shanlian confirmed that in his consulting capacity at the township Potter did not have the capacity to subcontract like he did with Waldorf at Warwick Pointe Academy. He presented his invoices to be paid through ABZ Environmental. and most of the billing belonged to him.
