FLINT (CCN) — One of the co-founders of Flint's Operation Unification Inc., has alerted The Morning Gazette Radio Show about a press conference they've scheduled for Tuesday at Beecher's Village Conference Hall. The organization has been involved in lawsuits with the City of Flint and Genesee County over millions of tax dollars used for projects by the non-profit corporation formed in 2004 by Charles Young Jr. and Lela McGee-Harvey.

McGee-Harvey told The Morning Gazette Radio Show Monday about the press conference to discuss a $45 million federal court whistle blower and protection order lawsuit filed against Genesee County and its circuit court for what she describes as "egregious injustices and violations... Evidence, substantiating the years of Chief Judge abuses of the courts system injuring and denying certain citizens and (businesses) their constitutional rights."

It's not her first time in the headlines. She appeared on The Morning Gazette Radio Show in 2017 to demand an accounting of where millions of dollars has gone after donations from across America from celebrities aiming to help Flint residents during the water crisis.She accused foundation leaders of using the funds for their own administration staffs and expenses.

McGee-Harvey's son is the business manager for NBA star JaVale McGee who spent much of his childhood at her house while his mother, Pam, played professional basketball overseas. His sister plays in the WNBA and married a NFL player. Pam and twin sister Paula, who are cousins of McGee-Harvey, were all-state basketball players at Flint Northern before becoming All-Americans as college stars at USC. Pam hosted a reality TV series with JaVale before he went to the Golden State Warriors to win the last two NBA championships. He's currently in the starting lineup of the Los Angeles Lakers with superstar LeBron James.

McGee-Harvey has hosted an inspirational weekly radio program on Flint radio station WFLT 1420 AM every Saturday morning for several years under the Operation Unification sponsorship and corporate documents show the non-profit firm's address at the Saginaw Street office of Beecher's Village Conference Hall. Young and McGee-Harvey are no longer listed, however, as corporate officers of Operation Unification Inc., on documents filed with the State of Michigan for its 2018 annual report.

Genesee County Circuit Court records also show garnishments against multiple banks around Genesee County for a 2015 lawsuit filed by the county against Operation Unification Inc. Court records show a motion for reconsideration was filed on behalf of the corporation after a motion ruling Monday for partial summary disposition in a case filed by the City of Flint in 2013. Lawsuits began flying from both sides after Young and McGee-Harvey were involved with the Smith Village project in a City of Flint neighborhood off Saginaw Street, near 5th Avenue. The project to build low-income homes began in 1998 under former Flint Mayor Woodrow Stanley's administration, but fizzled until federal pressure led to former Flint Mayor Dayne Walling re-starting the project in 2010.

Walling's administration originally tabbed Metro Community Development to build 83 houses before the end of 2011 to avoid paying back federal funds earmarked for the development, but only six were completed by mid-2011. Young formed Smith Village Construction Services LLC in June of 2011 after the city faced a potential $1.3 million penalty to repay federal funds taken to re-start the Smith Village project with Metro Community Development. Young's company had previously led a project to rehabilitate homes in the City of Flint with a federal stimulus-funded Neighborhood Stabilization program. Mayor Walling later switched to other contractors after city officials and Young were pointing fingers at each other over continued problems with the project that has included millions of dollars in federal investment with city and county funding.

FLINT (CCN) — Lela McGee-Harvey came out swinging against various community leaders Tuesday during a press conference at Beecher's Village Conference Hall. She said a $45 million federal whistle blower lawsuit filed with partner Charles Young Jr., exposes public corruption by city and county officials, and others. Among her targets were Genesee County Chief Circuit Court Judge Richard Yuille, Genesee County Corporation Counsel David Leyton, Flint-Genesee Chamber of Commerce President Tim Herman, former long-time Mott Foundation President BIll White and former City of Flint Emergency Financial Managers Mike Brown and Ed Kurtz. The Morning Gazette Radio Show was the only local media outlet at the press conference and McGee-Harvey said a "black out" was ordered by "powerful forces who want to shut us up." She said documents have been turned over to the FBI and newly-elected Michigan Attorney General Dana Nessel. A video of the press conference is available by clicking here. The Bureau of Professional Licensing held a formal complaint for Young and Operation Unification On May 17, 2017. (Docket # 17-017072 File# 21-15-326104 on
license # 21-02-1999395.
The Administrative Law Judge held a hearing on 1-25-2018.
On 3-13-2018 in Lansing the Michigan Board of Residential Builders, and Maintenance and Alteration contractors revoked the license of Operation Unification and gave the corporation a $12,000 fine.



The first formal complaint was received on November 19, 2015. The First Superceding Formal complaint both withdrew and replaced the original.

The residential builders license as issued in December ,2010 but as suspended for a failure to designate a person with an active individual residential builders license to serve as a qualified officer. The license lapsed in May of 2016.

In May of 2011 Elliott Julius Jones as designated as a qualifying officer. Jones had a builders license since July 15, 1986 and continued his license until June of 2013 when it lapsed .

The State found in 2016 the obituary of Elliott Julius Jones who as deceased as of June 10, 2013 at the age of 68. However on July 22, 2013, the respondent submitted an on-line license renewal application for renewal of the corporation license. The State was never notified of the need for a new qualifying officer due to death.

In December of 2013 Young obtained a City of Flint building permit (# PB 13016) using a copy of an authorization by Jones allowing Young to act as his agent in obtaining building permits. Contracted to perform repairs to a fire damaged home, Operation Unification received payments of $73,525 and never completed the work. On January 27, 2015 the homeowner filed a complaint with the State. The City of Flint Building Inspector verified the long list of violations on May 18, 2015.

Topic: Operation Unification and more-How much fraud?


Consumers Energy filed a lawsuit on March 1, 2013 against Operation Unification, Inc., Village Food services, Charles Young, Lela (McGee) Johnson, and Joanne Burks, Jointly and Severally. Case # 13-100007 CK and the Judge was Richard Yuille.

The complaint links all of the defendants to the business address of 2050 Warner St. in Flint.

#7. Defendant Charles young is the principal shareholder of Operation Unification, Inc. and is involved in the management and day to day operations odf the company. Plaintiff is informed and believes that Mr. Young is also a shareholder of Defendant Village Food Services Inc.

#8. Defendant Operation Unification, Inc. is a company owned and operated by Defendant Young, which purchases and rehabilitates houses, and owns apartments and commercial properties in and around the City of Flint.

#9. Defendant Young was the principal shareholder and manager of OU Homes, Inc., a dissolved Michigan Corporation. OU Homes, Inc. owned and rented commercial properties.

#10. OU Homes, Inc. incurred large utility bills for gas and electric service which have not been paid. In addition, Consumers Energy Co. investigators found theft of energy services at numerous properties owned by OU Homes, Inc. for which Operation Unification, Inc. is liable.



The lawsuit further alleges that Charles Young moved the utilities from OU Homes to Operation Unification, Village Shore Properties, Inc. and Joanne Burks and also Village Food Services and Lela Johnson. Young also promised $10,000 a month until the bills were paid. These payments were never made.

Paragraph # 26- Operation Unification, Inc. and Village Food Services, Inc. have the same members, officers, and directors, and businesses, as the defunct entities Operation Unification, Homes, Inc. and Village Shore properties, Inc. and Defendants Charles Young, Lela Johnson and Joanne Burks have used these and the other corporate entities to perpetrate a fraud upon Plaintiff in order to obtain utility services an avoid payment for such services.

#28- The corporate defendant and the dissolved corporations have common management and business purposes, properties, operations, customers, supervision and ownership.

#29- On information and belief, at the time of entering into the contract for utility service with Consumers, the corporate Defendants and the dissolved corporations were undercapitalized rendering them unable to meet their obligations.

#30- Adherence to the fiction of separate corporate existence would sanction a fraud.


#39- Defendants have repeatedly, improperly, and without authorization, restored utility service after service has been discontinued by Plaintiff because of non-payment and unauthorized usage, constituting theft of energy services.

#40- Defendants actions are in violation of MCL 600.2919(a) and the Plaintiff is entitled to recover three (3) times the amount of actual damages suatained, $92,704.20 plus costs and reasonable attorney fees.

The Default Judgment was for $29,112.60 in damages, $640 in costs and $5,000 for attorney fees for total of $303,752.60.


Charles Young filed bankruptcy as an individual. His co-debtors attempted to cite his bankruptcy as a reason to stay the proceedings although Young never requested such a stay.
Consumers Energy, in their response to the Defendants' Motion To Set Aside Default, (Paragraph 6) .....Plaintiff's Complaint in this action alleges liability primarily on the part of Operation Unification, Inc., who was the account holder for the Consumers Energy services at the properties where the debts to Consumers Energy were incurred, Village Food Services, Inc. is also responsible for the debts. Individual Defendants Charles Young, Lela Johnson, and Joanne Burks, incurred liability as they are the corporate officers who participated in the fraud on Consumers, permitted theft of energy services, failed to ensure that the corporate entities paid the obligations incurred, and further are personally responsible for the debts.

#7- .......and affirmatively asserts that Plaintiff's knowledge of the bankruptcy of the individual debtor, Charles Young, is completely irrelevant to the instant action as there is no co-debtor stay, and Mr. Young's bankruptcy petition merely serves to absolve mr. Young of personal responsibility for business debts incurred. The bankruptcy filing does not relieve Operation Unification, Inc., Village Food Services, Inc., or the individual debtors of their responsibility for the debts incurred.

Attorney Adam Devlin had participated in the discussions of the Consumer's Energy demands for payment. "Failure on the part of Mr. Devlin to advise his clients of the consequences of failure to answer the Complaint does not constitute a basis for setting aside the default in this case,....

#10. .....Defendants have no meritorious defense to the allegations of this Complaint. Charles Young has chosen to file an individual bankruptcy, and Consumers Energy asserts there is a strong basis to object to the discharge of the debt by Mr. Young, given the evidence that suggests his participation in fraudulent transfers of accounts, efforts to avoid payment and repeated instances of energy theft at properties owned and managed by the Defendants.

State Representative Woodrow Stanley interceded on behalf of the corporation in March 2010 and Consumers did meet with Young.

Memo of 6/11/2010 from Kevin Keane of Consumers to Young noted that consumer had found 5 homes being rehabilitated that had jumpers in the meter socket and no meter and no request to provide services. Consumers also found tenants using false name to avoid paying previous bills after Consumers was assured they would receive only valid tenant information.

Memo of 9/29/10 from Dawn Bullard of Consumers Revenue recovery/fraud unit of Consumers Energy. They have identified 8 properties with bypassed meters. She states she has attempted workout payment plans at the request of Stanley, but Young and his business entities fail to keep their part of the deal. They are refusing to turn on utilities for their properties.

A new lawsuit has been filed against Operation Unification, Charles Young and Lela McGhee-Johnson. This lawsuit, brought by Joyce Ellis-McNeal is in Judge Farah's Court (15-105167) Ellis McNeal has Attorney Tara Parker of Burton, who filed the lawsuit on July 15,2015.

Ellis-McNeal states she entered into a commercial rental agreement for a section of the Market Facility of Operation Unification for her business venture, the Digital Café. The Digital café was to be a prototype "geared toward serving the disenfranchised community by providing community members with access to the Internet."

The agreement was a one year lease with 2 one-year options to begin at 12.00 pm on May 8,2014. The $8,000 security deposit demanded $6,500 immediately and the remaining $1,500 due within 60 days.

Ellis McNeal alleges she was refused the keys to the facility after paying the initial deposit per the terms of the agreement.

The lawsuit states Charles Young and Lela McGhee-Johnson were co-owners of the facility. Operation Unification is a non-profit and should not have owners. At one time, Lela McGhee-Johnson was once a stockholder in the Village, described as a for-profit component of the non-profit. The address Ellis-McNeal paid to lease, G 5246, was part of the Village and was lost for unpaid taxes.

Young, throughout the history of Operation Unification, has transferred ownership of the corporation properties to serve his needs.

The lawsuit alleges Ellis-McNeal, in anticipation of starting her new business venture, spent $5,000 on various tasks and contracted with Shawn Jones, owner of the Comp Guy, for the wiring and café set up. Jones was to build 13 new broadband computers and Jones accumulated significant debt procuring the needed software and hardware for the Digital Café.

Ellis-McNeal recounted her embarrassment and loss of credibility when she was unable to explain to investors why she could not access her prospective business.

Ellis-McNeal states she turned to Gregory Eason, a third party consultant, for assistance in obtaining a resolution. Young and McGhee-Johnson steadfastly refused to allow her access. Young allegedly threatened to file bankruptcy to prevent Ellis-McNeal from exercising her legal rights. The lawsuit alleges McGhee-Johnson responded to demands for the return of the deposit with the comment to "take a number and get in line"


It appears that Operation Unification has filed for bankruptcy

Joyce Ellis- McNeal won her lawsuit but I seriously doubt she will get her money.
