Yesterday the Flint Journal printed the list of upcoming foreclosures. The list has never been this long and it looks like much of the north end and east side are on the list.

The most interesting observation is the foreclosures shown for Operation Unification Inc., the Flint area non -profit getting nearly all of the CHDO and Neighborhood Stabilization Program (nsp) money fror both Flint and Genesee County, as well as two of the principals are on the list big time.

IS THIS CRONEYISM OR KICK BACKS? I don't know, but I sure would like to.

Even part of the office located on Warner Ave, used for the Operation Unification and aprtments on Lippincott are on the list. It was transferred into the name of Joanne Burks, the apartment manager and board of director for the corporation is on the list. Also check out the list for Charles Young jr. as they appear to be the properties belonging to The Village in Beecher.

Flint City Council may have violated federal procurement rules when they initially transferred the nsp contract from another agency to Operation Unification.

The 2009 property taxes for the apartments on Lippincott are in forfeiture with the county for a total of $22, 445.60.

And yet both the city and the county are giving Operation Unification NSP money and CHDO money . The question is why?

Could it be because it's a nonprofit 501(c)(3)? QC deeds were probably to assign any personal interest that records might have shown he had in the property so records would properly show it belongs to nonprofit.

Federal rules state that members of a non profit may not enure any benefit from the non profit. other non profits take out loans in the name of the nonprofit and use the asset as collateral for the loan. Since the financial documents provided to the federal government showed no assets, would they have qualified for a loan?

Young files his 990's stating the company has neither assets nor employees. Otherwise his nonprofit would have to show them in a different 990 format and not the EZ.

To enter into a contract with the City of Flint , any entity must sign a statement showing the entity does not have any tax obligations unpaid. Flint is a Home rule city and under the Michigan Home Rule Act, the city cannot enter into a contract with an individual or entity that owes taxes!

The Natalia address in Davison was once owned by his apartment manager Joanne Burkes, Then it was transferred to Young and is still shown to be her address.

If you went to Guide Star or Foundation Finder, you would note the non-profit has a different set of Board of Directors. Those directors, except for the Treasurer ,were all employees of his Detroit corporation SDE Business Partnering.

According to your records, some of the the directors you show are also employees of the sister for profit organizations. At least two allegedly had a stock interest in the for-profits. Plus they have only one board for all three entities. The meetings shown in their application addressed the concerns of the intermingled non-profit and for-profits.

It appears that the Operation Unification Treasurer on the federal documents is the originator of the financial documents such as the 990's. No audit has ever been performed on this corporation. Their by-laws designate this is the Treasurer's role.

The for-profits were not taken into consideration in their application as required under HUD rules. The intermingling of the three entities without a formal agreement is a violation. The organization was approved without a complete application. Also the documents used to approve this contractual arrangement were contradictory and it appears these contradictions were not challenged.

On 4/2 2009 and 4/7/ 2009. the for-profit OU Home Inc quit calimed 901 Lippincott to Charles Young jr. On 4/7/2009 a $100,000 mortgage was recorded to Young from the City of Flint Economic Development Corporation.

Where was due diligence as 2009 taxes not paid and there was no money paid as consideration for the transfer. The store was a failure and now sits vacant with 2 years of taxes owing.

The Fairhaven address is in foreclosure under the name of Charles Young for 2008 taxes of $758.71.

And due to the amount of funding involved, how can anyone be made whole if there was fraud or wrongdoing?

I have amassed a huge collection of HUD OIG audits and reports.The burden of responsibility falls on the Participating Jurisdiction (PJ), which in this case is Genesee County and the City of Flint. The PJ has to ensure the applicant has capacity and meets the criteria for the CHDO certification.

The staff in DCED is responsible for knowing the federal regulations and applying those regulations to the applicants. In 2001 the Office of Inspector General informed HUD that the use of the 97-11 (a CHDO checklist) was inadequate and stated a public records search was necessary. since that time, Hud has put together trainings and a CHDO toolbox for states and eligible communities to use to verify eligibility.

In my opinion, some of this agency's applications were incomplete and ambiguous. With so much contradictory information, I have to wonder why these applications were not further researched. It took me less than 3 minutes to locate the Detroit lawsuit that alleged Young took assets from his Detroit corporation to create Operation Unification. I went to the federal court and pulled the 184 page pleadings and other documents. There were certainly enough questions for both governmental entities to use caution.

An agency must demonstrate capacity. This agency stated no employees, no assets, and then showed three staff members, each being paid $40 to $70 per hour. It shows an arrangement with the 2 "sister for-profit: without a separation of the entities and no written contract between the entities. One proposed staff member was Young's son and a former employee. Their resumes showed them working for Operation Unification for months. and up to a year. Their board composition did not have the required mix of low income and separation.

Bottom line-Expect repayment.

"Program fraud Civil remedies Act of 1986",provides federal agencies, which are the victims of false, fictitious, and fraudulent claims and statements with an administrative remedy to recompense such agencies from losses resulting from such claims and statements; to permit administrative proceedings to be brought against persons who make,present, or submit such claims and statements; and to deter the making, presenting , and submitting of such claims and statements in the future.

Title: The District of Columbia, Washington DC, Did Not Administer Its HOME Program in Accordance With Federal Requirements
We audited the District of Columbia's (grantee) administration of its HOME Investment Partnerships program (HOME) at the request of the U.S. Department of Housing and Urban Development's (HUD) Office of Affordable Housing. This is our second and final of two reports issued in relation to the grantee's administration of its HOME program. The objective addressed in this report was to determine whether the grantee properly administered its HOME program by providing home ownership and rehabilitation assistance in accordance with Federal requirements, ensuring that its Community Housing Development Organizations (CHDO) were eligible and complied with HOME program requirements, and implementing sufficient controls over the receipt and expenditure of HOME funds.

The grantee did not administer its HOME program in accordance with Federal requirements. It (1) obligated more than $2.5 million in HOME funds for an activity/project that was significantly delayed and not completed, (2) did not properly manage funds that it drew for downpayment assistance and financing of home repairs, ( 3) committed and disbursed CHDO operating funds for an ineligible CHDO, and (4) did not properly account for program administrative funds. These deficiencies occurred because the grantee did not have and/or implement sufficient procedures to ensure that it complied with program requirements. As a result, it charged more than $1.6 million in ineligible costs to its HOME program and could not support approximately $6.5 million in costs charged to the program. The grantee also accumulated more than $1.5 million in funds that it could have used to improve its administration of its HOME program and/or fund additional eligible HOME projects.

We recommend that the Director of HUD's Washington, DC, Office of Community Planning and Development require the grantee to recover more than $1.6 million that it spent on ineligible expenses and provide support for approximately $6.5 million in expenses or repay that amount to the HOME program. In addition, the grantee should use approximately $1.6 million in accumulated funds to improve its administration of the program and/or fund additional eligible HOME projects. Lastly, we recommend that the grantee create and implement procedures to ensure that HOME funds are disbursed and used in compliance with applicable requirements.
