Many North end residents have been hot that both Kurtz and Brown are still in Flint government. The outrage has extended to council and the citizens are really pissed with a number of council actions.

Number one outrage is the lack of action regarding possible violation of the residency rules of certain council members.

Under the Flint City charter, specifically section1-603, the City Council 'shall declare the forfeiture of the office of any elective officer or appointee and may remove for cause any person appointed to an office for a fixed term. In every case there shall be a public hearing before the City council with notice published in the same manner as notice of propsed ordinances.

A council member charged with conduct constituting grounds for forfeiture may not participate in the resolution of the charge".

B. " The position of an elective City Officr or an appointee shall be forfeited if he or she
1. lacks at any time the qualifications required by law or this charter or
2. violates any provision of the charter punishable by forfeiture of office.

Every elected City official and every candidate for elected office shall be a registered elector in the district he or she represent or seeks to represent.

Rumor has it that Delrico Loyd has resided in the 8th ward while continuing to represent the 1st ward and other council are aware of this. rumors are also floating about other council members.

Other residents in Woodcroft talk about Loyd residing in their area. So why hasn't council requested a hearing for removal of office because Loyd no longer meets the qualifications and allow him to defend, deny or dispel these allegations.

Word is that Loyd does not plan on seeking office for another term, but in the meantime he is acting as a council leader in the first ward. Should any council person that is aware of any disqualification for office and who fails to act worthy of being re-elected? Is a culture of corruption and deceit ingrained in the mentality and structure of the council?

The Vacancies in Office Act states an office in a local unit is vacant when the officer ceases to be an inhabitant of the local unit for which they were appointed.


MCL 201.3

201.3 Vacancies; creation.

Sec. 3.

Every office shall become vacant, on the happening of any of the following events, before the expiration of the term of such office:

1. The death of the incumbent;

2. His resignation;

3. His removal from office;

4. His ceasing to be an inhabitant of this state; or, if the office be local, of the district, county, township, city, or village, for which he shall have been appointed, or within which the duties of his office are required to be discharged;

5. His conviction of any infamous crime, or of any offense involving a violation of his oath of office;

6. The decision of a competent tribunal, declaring void his appointment, or,

7. His refusal or neglect to take his oath of office, or to give, or renew any official bond, or to deposit such oath, or bond, in the manner and within the time prescribed by law.

Delrico Loyd still owns a home in the !st ward, but do we really believe he doesn't live with his wife.

Perhaps the charter needes to be amended to better define residency and include provisions that if an individual has aa family, that the domicile is with the family unless legally separated.

There are similar aguments in other communities. One is Dearborn where a council candidate Thomas was challenged for having a homestead in Florida in his wife's name while his Dearborn home was up for sale. what is to prevent someone from renting a room in Flint to maintain residency while really living elsewhere?

Michigan State Police investigation of Flushing Township trustee turned over to prosecutor

FLUSHING TWP., MI -- A Michigan State Police detective says he's turned his investigation of township trustee Mike Gardner over to the Genesee County prosecutor.

State police Detective Sgt. Dave Rivard said today, Nov. 13, that the investigation is complete but did not comment on it further.

Prosecutor David Leyton could not immediately be reached for comment.

Gardner, whose trustee term expires next month, lost his campaign for county Board of Commissioners last week.


The state police investigation arose from a complaint from his opponent -- incumbent Commissioner Archie Bailey, D-Flushing -- who said Gardner may have been using a home in Bay City as his principal residence while serving as a township trustee.


Gardner has said Flushing Township has been his primary residence but said just days before last week's election that he did sign an affidavit claiming the Bay City property was his principal residence.

The affidavits are filed to give tax relief to property owners for their principal residence.

Gardner has said he wasn't sure if he ever received a tax benefit after the affidavit was filed 11 months after it was signed. Gardner denied having personally filed the report with Bay City.

He eventually lost the Bay City home after a mortgage company started foreclosure proceedings.

Gardner could not be reached for comment.

Genesee County commissioner candidate's residence is subject of Michigan State Police investigation

GENESEE COUNTY, MI -- Michigan State Police are investigating an incumbent county commissioner's complaint that his opponent may not be qualified to vote in the district he wants to represent.

Commissioner Archie Bailey, D-Flushing, said in an Oct. 22 letter of complaint that the primary "issue here is whether or not (Republican candidate) Gardner violated state law by living in Bay City, Michigan, while serving as a trustee on the Flushing Charter Township Board of Trustees at the same time."

Gardner, who is leaving his trustee position to run against Bailey, said there's no issue with his residency and accused his opponent of a last-gasp act of political desperation.

"The whole thing is an example of Archie playing dirty politics," Gardner said. "There's a Genesee County political machine that doesn't want me elected."


Bailey would not comment on his request for an investigation into Gardner's residency, saying he would let the results of the review speak for itself.

"I'll comment when the investigation is completed," said Bailey, who has spent decades in area politics as a county commissioner, Flushing mayor and Flushing City Council member.


Bailey is facing an aggressive challenge from Gardner in a district that was redrawn after the 2010 Census.


Initially made Oct. 22 in a letter to county Clerk Michael Carr, Bailey's request for an investigation of Gardner was referred to county Prosecutor David Leyton, whose office forwarded it to state police.

Special Assistant Prosecuting Attorney John Potbury said the case was turned over to MSP after the agency agreed to look into the allegations.

State police Detective Sgt. Dave Rivard confirmed he has been assigned the case and said it likely will not be resolved before Election Day.

"I don't see how it can be ... There's leads that need to be followed up," Rivard said.


Bailey's three-page letter requesting an investigation refers to court documents, including a lawsuit filed against Gardner by Wolverine Bank, which claimed he and his ex-wife failed to repay a loan for a home in Bay City and a quit claim deed that allowed another Flushing Township official to purchase the Gardner home during a foreclosure redemption period.

Gardner said he has continued to rent the home in Bay City so that he has a place to see his children and to avoid disrupting their lives. He said he continued to maintain his residence in Flushing Township.

"Buying a property outside Flushing Township doesn't mean I live there," he said.

Flushing Township Treasurer William Noecker said he purchased the property from Gardner on a quit claim deed so he could buy it back from the bank during a redemption period.

A redemption certificate shows Noecker and his wife, Victoria, paid the bank that foreclosed on Gardner $126,515 for the property.


Gardner said he's paying Noecker rent so that his children can continue to live in the home. Noecker called the purchase an investment that also benefited a colleague and a "loving, kind father."

The township treasurer called Bailey's complaint a "cheap shot" and a "snake in the grass trick."

Noecker said Gardner spends some time at the home he is renting in Bay City but spends the majority of his time in Flushing Township.

Gardner said he has never filed for a primary residence tax credit in Bay City.

I seemed to have hit a nerve for the fourth ward residents, some of whom have attempted to file complaints that Josh Freeman no longer lives in their ward. Allegedly the politicians they complained to responded by telling them to wait for the election and vote them out. This is outrageous!
These politicians that no longer live in the are making decisions and have made decisions that impact the lives of those who legitimately live in the district.

Residents are insisting they know that Freeman no longer lives in the ward. This is an issue the Ombudsman would have investigated if the office had not been eliminated. Corruption will continue in the Flint City Council if those who are charged with the responsibility of investigating wrong doing of fellow politicians neglect or refuse to fulfill these responsibities.

I am trying to find out which agency the residents contacted. These agencies could or should be charged with a failure to perform their duties. I was told at lunch that a process exists to petition the Circuit Court to require these political cronies to perform their jobs.

If an investigation clearly demonstrates these council legitimately still reside in the community, and the investigation is not a sham, then the residents will have an answer.
