With so many Pierson Hood cases going nowhere, it makes you wonder what is wrong with the prosecution or did they move too quickly.

Murder charges dismissed against second Pierson Hood suspect, still charged with another killing

Gary Ridley | gridley@mlive.com By Gary Ridley | gridley@mlive.com

on October 07, 2013 at 5:45 PM

FLINT, MI -- Murder charges have been dismissed against a second suspected Pierson Hood gang member accused of being involved in a fatal double shooting at a Mt. Morris Township motel.

Genesee Circuit Judge Joseph Farah dismissed the case against Jajuan Fordham after authorities refused to make a witness in federal custody available in the case.

Fordham, 35, was charged with two counts of murder, conspiracy to commit murder and four counts with assault with intent to murder after authorities claimed he and other suspected members of the Pierson Hood gang killed Kenneth M. Edwards, 19, of Clio, and Marcus L. Ballard, 25, of Flint, during a September 2004 shooting at the Super 8 Motel on Pierson Road in Mt. Morris Township.

Attorney Philip Beauvais, who represents Fordham, asked for the dismissal after prosecutors refused to produce the witness.

Genesee County Prosecutor David Leyton said prosecutors would have liked to proceed with the case.

Fordham is the second accused Pierson Hood suspect to have murder charges dismissed as a result of the witness issue. Charges were dismissed earlier this year against Deonte Matthews, who was also accused in the hotel shooting.

Farah rejected a number of arguments made by prosecutors on why the case should have moved forward.

Matthews was sentenced Oct. 1 by Farah to one year of time served in jail after pleading guilty to possession of less than 25 grams of a controlled substance.

Matthew's attorney, Charles Grossman, argued that federal authorities were refusing to provide a confidential witness that may have cleared Matthews in the killings.

Grossman has claimed the witness indicated that Matthews was not one of the two shooters at the motel.

"Matthews has always maintained he was never there, in fact he filed an alibi that said he was with his ex-wife up in Tawas City when it happened." Grossman said.

Grossman also claimed that the witness indicated that fellow Pierson Hood member Samuel Wood was actually one of the two shooters at the motel, not his client.

Wood reached a plea agreement in his case and was expected to testify against Matthews.

Authorities believe Wood, along with a number of other co-defendants, sought to kill members of the rival Merrill Hood gang when they shot up the room at the Super 8 Motel in retaliation for an attack on Wood's older brother, Garner Wood.

Bobby Younger, a suspected Merrill Hood member, was believed to have shot Garner Wood -- who also pleaded guilty to charges associated with the Pierson Hood shooting -- and it was believed Younger was at the motel.

However, Younger was not in the room when Pierson Hood members allegedly opened fire on the room with 9mm handguns and an AK-47 rifle, according to court testimony.

Fordham is still charged with murder, assault with intent to murder and multiple firearm offenses in the Dec. 5, 2006, killing of Alvin Rauls.

Rauls was in a car with his girlfriend at the intersection of Black Avenue and Billings Street when they were shot at around 10:20 p.m. Tuesday. She survived the shooting and was taken to Hurley Medical Center, but Rauls was killed.

FLINT, MI -- Flint police had a busy weekend responding to seven shootings, including one homicide and the shooting of a 4-year-old boy.

Darryl Andre Cold Jr., 21, was found shot to death around 10:40 p.m. Friday, Oct. 4, in his vehicle near the intersection of East Flint Parkway Boulevard and Aubrey Street. The white van had run off the roadway and collided with a tree, police say.

It was the first homicide in the city in nearly a month. The city has 39 homicides this year, according to Flint Journal records.

A 4-year-old boy was listed in good condition at Hurley Medical Center after he was struck by a bullet late Saturday night fired into an East Bundy Street home, according to police.

The incident began around 11:30 p.m. when police were called to the 700 block of East Bundy where suspects approached the backyard of a home and began shooting at the home.

According to police, the boy was watching TV in his bedroom when he was struck in the right thigh. The bullet exited the right thigh and lodged in the left thigh. There were no reports of any arrests in that case.

Hours later, two men were shot on around 2 a.m. Saturday at a residence on Broadway Boulevard near East Boulevard Drive. Police found a 23-year-old man lying in the backyard with gunshot wounds to the chest and left arm and a 28-year-old man shot in the right bicep.

The 23-year-old was originally listed in critical condition, but later upgraded to fair condition while the other man was listed in good condition. There was no information in the report as to what led up to the shooting.

There were two shootings early Saturday morning in the 4000 block of Clio Road. One man was shot in the hip around 12:30 a.m. Saturday while he was sitting in his vehicle. Two men approached the vehicle and shot inside and then fled east then south on foot behind the building.

The victim was listed in good condition.

Another man was shot in the right calf and listed in good condition. It's not clear if the two incidents were related.

Police responded to Deja Vu nightclub, 2402 S. Dort Highway, for a report of a felonious assault a little before 3 a.m. Saturday, Oct. 5, and found a 25-year-old man critically beaten.

Also on Friday, officers were called around 6:45 p.m. to the 4000 block of Court Street for shots fired into the home and found the victim with a single gunshot wound to his left lower leg. He was listed in good condition.

Flint man pleads not guilty to federal charges in gun incident at public housing complex

Gary Ridley | gridley@mlive.com By Gary Ridley | gridley@mlive.com

on October 07, 2013 at 4:30 PM

FLINT, MI -- A Flint man has pleaded not guilty to federal charges that he threatened a man with a gun at a south side public housing complex.

Martez L. Ayers, 31, was arraigned Thursday, Oct. 3, in Flint U.S. District Court on one count of being a felon in possession of a firearm following an April 11 incident at the Howard Estates public housing complex.

Police say resident at the housing complex reported hearing banging on the front door of his apartment around 6 p.m. April 11. The resident reported finding Ayers on the front porch.

Ayers was later spotted in the kitchen window of the apartment when he allegedly pointed a silver handgun at the resident and threatened to kill him, according to an affidavit filed with the court by a Michigan State Police trooper.

The resident told police that Ayers then fled the scene in an older model, white Chevrolet Caprice.

Flint police spotted a vehicle matching the description at Country Club Manor apartments, near Dort Highway and Lippincott Boulevard.

Police approached the vehicle occupied by Ayers and a female passenger. Ayers allegedly exited the driver's seat of the vehicle and was placed under arrest for felonious assault. A 9-millimeter handgun was found on the passenger floor board of the vehicle, according to the affidavit.

Ayers has an extensive criminal history, including convictions for discharging a firearm at a building, discharging a firearm from a vehicle, possession of less than 25 grams of a controlled substance and multiple charges of fleeing and eluding and resisting and obstructing police.

State records show Ayers was released from prison Jan. 3.

Ayers originally faced state charges stemming from the incident but they were dismissed once federal prosecutors initiated their own case.

He is currently being held in federal custody pending trial.

Flint man gets federal prison time for possession of gun while free on bond for gun crime

Gary Ridley | gridley@mlive.com By Gary Ridley | gridley@mlive.com
on October 08, 2013 at 2:00 PM, updated October 08, 2013 at 2:09 PM

FLINT, MI -- A Flint man will spend nearly a decade in federal prison after pleading guilty to illegally possessing a firearm while he was on bond for federal charge of illegally possessing a firearm.

Garland Dontrell Garner, 30, of Flint was sentenced to 9 years, 2 months in federal prison after pleading guilty to being a felon in possession of a firearm while on pretrial release, according to a judgment filed Friday, Oct. 4, by Flint U.S. District Judge Mark A. Goldsmith.

Garner was initially indicted Sept. 5, 2012, on charges of being a felon in possession of a firearm after it was discovered that he was allegedly in possession of a 20-gauge shotgun Aug. 23, 2012, while in the 100 block of East Gracelawn Avenue on the city's north side.

Court records show Garner was released Nov. 6, 2012, on $10,000 unsecured bond while awaiting trial. However, his bond was revoked roughly three months later after he was again arrested on suspicion of being a felon in possession of a firearm.

Flint police officers stopped a vehicle March 21 in the 600 block of East Holbrook Avenue for not having a license plate light, according to court records. Garner, who was a passenger in the vehicle, was arrested on three warrants for failure to pay child support.

During the arrest, police observed the butt of a pistol on the floor where Garner's feet had been, according to court records. Police discovered a loaded 9-millimeter semi-automatic pistol with a nearly-full 30-round magazine.

Court records show Garner has served multiple previous stints in prison, including time for convictions of attempted assault with intent to do great bodily harm less than murder and multiple drug convictions.

Curious to know how and why condition went from good to dead in such a short period of time--at which "local" hospital?

Amanda Emery | aemery@mlive.com By Amanda Emery | aemery@mlive.com

The victim's friend told police she didn't see anything or anyone after her friend was shot. No suspect information was given in the police report.
