Federal government suspends Flint energy grants amid investigation; Mayor Dayne Walling launches additional review

FLINT, Michigan — The federal government has suspended the city of Flint's two energy grants, citing possible problems with compliance and allowable costs, Flint Mayor Dayne Walling said today.

The news comes amid a wide-reaching federal investigation of the city's stimulus-funded energy grant programs dating back to April 2009.

In a news conference at Flint City Hall, Walling said he welcomes the federal scrutiny and he is "committed to rooting out fraud and waste in Flint."

He announced the city is also initiating an additional review of the two energy grant programs, and a group of outside legal counsel will be assembled by the city attorney, he said.

"We should have some preliminary assessments within a month," Walling said, flanked by City Attorney Pete Bade and City Administrator Gregory Eason. "We'll continue to go above and beyond to cooperate."

Walling said his office received notice last week that the grants will be suspended as of Friday, July 29. The notice cited the ongoing investigation and possible issues with compliance, procurement and allowable costs, he said.

Walling said he wasn't aware of what spurred the action from the feds. He pointed out that the energy department's inspector general is handling dozens of audits of energy grant programs across the country.

"We have no details on specifics from the Department of Energy at this point," Walling said.

In addition to the federal government's suspension of the energy programs, Walling said his administration has decided to also freeze a federal grant program funded by the U.S. Department of Housing and Urban Development. Walling said that program has ties to a company that also has contracts with the city related to the two energy grants.

A federal grand jury has convened as part of the investigation into the city's energy grant programs.

Subpoenas issued to four city departments in May demanded more than two years worth of documents, check stubs, emails and audio and video recordings of city dealings, according to information obtained by The Journal under the Freedom of Information Act.

Walling said that, despite language on the subpoenas that indicated otherwise, no city officials have testified or are scheduled to testify before a grand jury. The city was only required to submit the requested information.

"Every member of my administration has fully cooperated with the review and investigation," he said. "We're going to make sure our taxpayers in this city are protected."

LOL! LOL! Walling had no choice as my understanding is the letter Walling addressed was suspending the program as of the 28th. Walling is trying to save face. Another dishonest action. Walling's actions mean the investigation is spreading.

Word is some DCED employees are searching for new jobs!

Did anyone see the 6:00 PM news where Channel 12 went to the alleged address of Advanced Solutions and found only an abandoned and boarded up building?

I told people before that the building was sold to Greater eastside Community Association (GECA) on a land Contract. When Fields couldn't make the payments, the land Bank continued to make deals with her so she could stay in the building. Woodrow Stanley and carolyn Sims were among those supporting these decisions.

Josh Freeman was the President of GECA when he was elected, although he failed to disclose this relationship on his council disclosure forms. Freeman signed the building back to the land Bank earlier this year.

(07/25/11) - For the past month, the United States Department of Energy has suspended funding for at least $1.3 million of federal grants for the city of Flint.

The action comes a month after an investigation into some of the city's spending practices was launched by the Department of Energy.

Flint is not the only city being audited. ABC12 reporters were told that it is common for cities to be reviewed on how they are spending or planning to spend grant money.

Mayor Dayne Walling held a press conference to address the audit. City Administrator Gregory Eason was standing with him.

Walling says Eason is one of two high-ranking mayoral appointees, who were asked to provide personnel files by Federal officials.

Supeonas requested information dating back to April 2009, months before Walling took office. The mayor insists it is simply a formality by Federal officials.

Walling told ABC12 that the city had five weeks to submit the documents, but sent them within 24-hours.

Walling also stated that the city is conducting its own independent investigation and welcomes the Federal oversight. He added that about half the planned work has been completed and some of the vendors have been paid.

For now, the grant funding has been suspended by the U.S. Department of Energy.

It is one thing to be reviewed about the stimulus money as the government has determined the stimulus funds were at high risk for abuse. However, many audits result in corrective actions and paybacks . Suspensions are usually a last resort.

The grant was initiated under Williamson, who resigned in early 2009. Interim Mayor Brown conducted the procurement process and a company with 17 years experience was selected. It was Flint council, led by former Councilman James Ananich, that stalled the initial contract and eventually led to the contract being given to Advanced Solutions and kate Fields. When Fields made her initial proposal to the procurement group, her proposed CEO was Greg Eason, who later became City Administrator.

One of the fraud warning signals for the Stimulus Pograms is the recent creation of a new company that receives the funding. Kate's company fits that description and her only claim to fame was that she built 2 energy efficient homes. Even that feat was filled with controversy and MSHDA had to bail her out.

MY NOTES FROM THE MEETING....

Yesterday 07/25/11 Droid thumb live blogged the Flint City Council meeting typos and all.. There Mayor Dayne Walling announced his full cooperation with an ongoing and rare FBI Investigation of City of Flint Activities. One Mayoral Opponent Daryl Buchanan had scheduled an “emergency press conference” last Friday on that issue.



From the Mayors announcement to council one corruption target of the FBI is an organization called Advanced Solutions run by Kate Fields, she also instructs at University of Michigan Flint or at least did last year.



Flint Mayor Walling strongly stated to the council and community that corruption will not be tolerated in his administration. He pledged to be transparent to the voters and regularly report on this issue. He seemed to blame the controversy on past administration but was rebuked by Flint City Council member Sheldon Neely that essentially the implementation of the federal program that the aledged miss appropriations came from was done during the Walling watch.



My corrected face book notes follow. They are numbered in the order they were posted, but here modified. in the order they were origonally presented with contemporaneous thought and commentary.



The Mayor was given special privlage to address the Flint City Council.



1.Mayor Walling talked about the FBI investigations. He is co-operationg. Some candidates [ Darryl Buchanan] are taking cheap shots. No Flint City employee is going before a grand jury on these public corruptions charges the FBI is investigation. The FBI is suboening information from before his administration. If so that would be during the Buchanan /Williamson administration. Buchanan was city administrator Daryl Buchanan was City Administration and is fully responsible for anything that occured during the Williamson Mayoral terms that he held that position.



2. The Mayor welcomes the Federal oversight. Federal Funds allocated to Flint are being frozen by the Federal government. Flint cannot spend its federal money allocated to it.



3. Mayor Walling is notifying vendors that the source of payment for their efforts has dried up and they will not be paid until and if the funds are released by the Federal Government.What hard ship is being placed on these businessmen. You wonder why any firm would risk doing business with the City of Flint.



4.The Mayor is doing an external legal review. This topic degenerated into Councilperson Neeley proclaiming the Mayor was going to hire an outside attorney to investigate him and his administration. This review effort would be hird by him and report to him.



5. There have been $450,000 in draw down of federal money that are being investigate amid allegations of public corruptions.

6. Flint Mayor Dayne Walling announced he welcomes early review by the FBI to stop corruption.



7.Walling pledged that he will not sweep problems under the rug in Flint its a big rug. Walling said we have a responsibility to be transparent. He will take questions from the council.



8. Flint Council person Josh Freeman asked how the external review will be paid for. Walling said out of the City Attorney Cost Center.



9.David Davenport was making noise and appeared ti be trying to disrupt the meeting.



10.Councilperson Neeley to Mayor Walling. A federal review of Flint is a serious matter and nnot to be brushed over.Walling responded ,there will be a whole series of issues. The Feds are suspending the funds until an investigation is completed.



11.Neeley to Mayor. What is the scope of review that you will assign to an attorney that you hire to investigate you?



12. Neeley to Mayor. The dollars in question were spent during your administration.



13. Neeley to Mayor. Ypu said prior administration but some time you Mr. Mayor will have to step up to the plate and take responsibility.

14. Walling said he has been proactive with his co-operation.



15.Neeley chastised the Mayor for blaming the council for weakening the city of flint purchasing guidelines when appropriating the federal money in question. There appears to be some council complicity in this issue. Ms. Fields was a darling of the Flint City Council and vilified by the Buchanan/Williamson Administration.



16.The Mayor of Flint Dayne Walling was strong in his presentation. He announced that he is freezing more of the money than the feds required. One thought is that he is punishing Fields and pulling all her funding. Pay backs can be hell. Council person Freeman asked if named Flint City employees were being suspended. I think he was talking about Steve Montel and Tracy Atkins. The Mayor said no, and appeared to dream up some sort of positive spin on that.



17.Kudos to the Mayor of Flint for going into the lions den to make this announcement and take questions directly from the council. That’s the toughness I expect from my Mayor of Flint.



18. Neeley chastised Flint City Council President Jackie Poplar for her rebunking of David Davenport. I think she went a little over the top but Davenport was fully co-operationg as this drew attention to him.Neeley said her relative and city department head Donna Polar was also talking loudly. Donna Poplar was talking to Barbara Griffiths Wilson said Ms Wilson later. My tjhought was that Jerry Springer has nothing on the turmoil of a Flint City Council meeting.



19.Flint City Council President than loudly announced the rules for the public to address the Flint City Council.



20. Alex Harris stopped by my seat to tell me some tidbits. The Federal Corruption charges are all on Wallings watch [ I doubt this] .



21. The public began to address the Flint City Council. The first speaker was the mother of a murdered child, heart rendering.



22. Looking at the council agenda another Attorney Dean Yeotis sewer lawsuit notice has been given concerning events of May 19 and 25. Have we not fixed this multi million dollar deficiency in out sewer system?



23.The mother of a murdered child is criticizing the recently announced cease fire a cowardly act by the city essentialy codeling criminal. My observatoin that we have had diversion programs for first ffendersfor decades this is just another variation.



24. David Davenport began has address toi the council talking about his alledged disruption of during Mayor Wallings presentation. He said he was laughing at the lies.



25.Davenport said that Walling is trying to blame the corruption charges on past city administrator Michael Brown.



26. David Davenport called anyone who supports Mayor Walling a criminal.



27. I continued my review of the city council agenda.

Item 110988 Settlement / Speer vs City of Flint. Violation of first amendment rights amount of $30,000 to Keith Speer and his attorney Leonard Kruse. The events surrounding this cause arose during and by the Buchanan/Williamson adminstration. Possible Buchanan should pay the money back to the city.



28. Other settlements, $12,500 to Charles Young, $30,000 to Kar;l Petrich, $75,000 to Christina Conely a whistleblower issue, $30,000 to Joseph Anderson.



29. Next public speaker Chris Delmoroney talked to signs on city property between the sidewalk and the road.



30. Council person Lawler refered the sign issue to the Flint City Attorney. I have a financial interest in this issue.



31. Mayor Walling was compared to Obama by one speaker.



32. Another speaker, Barbara Griffiths Wilson talked of the investigation of Buchanan when he was ombudsman for sexual harrassment, this eventually cost him his job and destroyed the reputation of that office by the removal and the protracted litigation. This speaker also was critical of Smiths residency.





33. Neeley then chastised Poplar for letting the previous speaker talk politics at the mike.

34. Flint City Councilperson Kincaid interjected that it was the Flint Emergency Financial Manage that gave the Flint Journal a sweet heart tax abatement. He actualy blamed the state intervention on this issue. When the council would not approve the abatement because of its conditions were not met the Flint Journal used its then great power to go to the state , destroy the mayor office, cripple the council oversight power cause the appointment of an emergency financial manager that gave them what the wants and now took. I think that is what he ment..



35.Flint City Council President Jackie Poplar then turned to Neeley in response to his criticizing her and said. Mr. Neeley when Mr. Davenport called me a whore you did not defend me . Why are you defending others now. Neeley and Davenport erupted, probably the desired result that ended with Poplar ordering the Flint police officers present to escort Davenport from the chambers which they did.He went loud.



36. At the public mike Eric Mays joined the fray. He said the Feds are coming after City Administrator Greg Eason. There will be indictments before the November election. The FBI is investigating a sitting Mayor of Flint Michigan that has never happend before.



37. Mays said that the police are investigation absentee ballot abuse. Eric is know as the king of absentee ballot campaigns. With prior allegations of abuse that resulted in changes of the state law.



38. Mays [ I assume talking about his absentee ballot advocacy] declares he will affect the rsult of the August election. He says he has done it three times before. Thanks for the heads up Eric that will justify any amount of increased scrutiny of any absentee ballot you touched or caused to be sent to a voter.



39. Alex Harris sai what the Mayor is selling is a fraud.




40 Harris said, do not fall into the shame that the feds are not looking at Walling. There was a meeting of a Federal Grand Jury on this issue July 6th. The mayor announced tonite that he is hiring an attorney to investigate him. [ Could this be an attorney to defend him?].Alex Harris said that he has documentation that mayoral appointee Tracy Atkins is double dipping like former police chief Dicks was and he was charged.



41. Alex Harris asks why his close friend and very public political ally Kate Field of Advanced Solutions is being thrown under the political bus and having these federal charges directed at her.



42. Harris pointed out Walling lost the funding for Montel and Dawn but kept them employed by paying them from other cost centers. He said the Mayor Broke the Law and not there is a full cover up in progress.

Williamson resigned in early 2009 so while they knew a DOE grant was coming, he did nothing to implement the contracts.

Flint, Michigan -- The Don is gone.


Mayor Don Williamson announced today that he is "retiring," finally putting to rest weeks of speculation.

In an 11:20 a.m. news conference, Williamson cited health reasons for leaving office. His resignation is effective midnight Sunday. He took no questions from the media, and read from a prepared statement.

"Last month, I celebrated my third sinus infection in 13 months and my eighth kidney stone since Nov. 1. My doctors have told me that I should think about relaxing my schedule and reducing the demands on my time," said Williamson, 75.

Williamson, a multi-millionaire, said his life has been blessed with financial and political success.

"In my political life, I received the greatest honor of all, the trust and respect that the voters of this great city placed in me when they elected me mayor in 2003 and then re-elected me in 2007," Williamson said.

Williamson praised new city administrator Mike Brown and deputy mayor Darryl Buchanan. Buchanan was present at the news conference but Brown was not.

Terry check out resolution 090709 where the Interim Brown administration proposed giving the DOE contract to Clean Energy out of Ypsilanti. It was Ananich that helped orchestrate the switch to Kate Fields Advanced Solutions LLc, a newly formed company.

When Fields initially presented her company to the procurement committee, Greg Eason was to be her CEO. Walling became Mayor in August of 2009 and the contract switch was made.

The federal government under 24 CFR 85.36 details the specific rules for procurement of entities using the NSP (stimulus) program.

Walling had the option of vetoing the contract and restoring the integrity of the bid process, but he chose not to.

What can more attorney's do? What you need is a forensic auditor and a specialized investigator. Alexandra Graemer of the Office of Inspector General has already investigated, sp what does Walling hope to accomplish other than try to stonewall the citizens over his administration'sgross mismanagement of the federal grant money.

Terry, Kristin longley did some great research and FOIS'd the search warrant returns and supoenas. Walling originally stated thet it was correct about Eason and Montle. being supoened to the Grand Jury.

Council persons have mentioned that Montle was being paid out of the energy grant. At one time I believe Atkinson was named too.

Terry - this is the third program to be suspended by HUD during the Walling administration. Several OIG complaints were made about this contract and brought up in M-Live. There is also a whistleblower lawsuit against the city and Eason over this contract.

Neeley has it right. Ananich was a close personal friend of Fields and sat on her board for years. He was President of GECA when he was elected, but he never declared it.

Sims on June 6,2008 ordered Nancy Jurkiewicz to "give Poor kate Fields some money". Nancy Jurkiewicz told the council that GECA did not qualify. GECA owed taxes and required an audit which they had no money for and once again the city was to blame for the lack of audit funds. Jurkiewicz was not about to break HUD rules for the council.

Sims sat on the land Bank Board and had just voted to help GECA with another chance to establish a new payment schedule on the land contract for the GECA office. Kate blamed Williamson for all of her troubles.

Have you forgotten the story of Fields and Freeman chasing Tamar lewis through Bishop Airport and taking pictures of Lewis when she was going to a HUD training conference. Fields wanted Tamar's mother prosecuted for tackling her to protect her daughter. It played out in the media.

Kate and friends spied on Williamson's home and followed him when he left in the mornings. He had to install the elaborate fencing security system when one of these stalkers scared his maid when she saw them peering in the window.

Williamson had GECA sued over her failure to renevate two homes on Maryland in a timely fashion. The city got the properties.

A third home on Maryland was owned by GECA and was being sold to an indivisual on a land contract. Kate accepted money as though she was buying the house, although the land contract was not paid off, She never consummated the deal and the land contract holder paid off the contract. She also never disclosed any of the land contract deal with the city and the land was still showing as owned by GECA.

Kate filed every kind of campaign complaint against Willamson and his wife that she could.DO YOU REALLY BELIEVE WILLIAMSON WOULD HAVE GIVEN A CONTRACT>

If i remember correctly the Journal reported on a judgement that this ccost center was unable to pay because it was greater than the money in the center.

The Jefferson settlement had to be paid in 2 payments and the Conley judgement had to be delayed by at least 3 months. This is not a practical solution.

What about the recent police judgement?

What a Walling Whopper. Williamson resigned before the procurement process had started. Brown did nothing wrong as it was his Clean Energy resolution thet hit council in April. That is why the investigion starts in April.

FLINT, Michigan — The U.S. Department of Energy may reinstate some of Flint's $1.1-million energy efficiency grant that was terminated for misuse amid a federal investigation.

In a letter sent today to emergency manager Michael Brown, energy department officials outlined strict conditions under which they would consider reinstating a portion of the grant, which they yanked in November for "serious mismanagement."

First, the city must amend its proposal and must repay about $215,000 in "disallowed" or "questioned" costs, among other requirements, the letter says.

If the proposal is approved, the city would be able to use an unspecified amount of the grant for a recycling plan and on energy efficiency upgrades at Flint City Hall, City Attorney Peter Bade said.

"I'm very confident we can comply with all the things they've listed," Bade said. "Every step of the way there will be significant monitoring by DOE (Department of Energy) and we will be very focused on the city’s side to ensure compliance."

The $1.1 million grant was originally awarded in 2009, but later came under scrutiny and was the subject of federal grand jury subpoenas and an FBI visit in May.

The grant was terminated in November after energy officials found the city failed to follow procurement standards as well as conflicts of interest and "serious lack of attention" to grant requirements, the department said at the time.

The city appealed the findings, which led to the department's reconsideration of the termination.

Bade declined to comment on whether the department's reconsideration has any implications for the federal investigation.

"I cannot speak to the FBI's investigation," he said.

Part of the city's amended plan for the grant includes a proposal for a curbside recycling program. Another includes energy efficiency upgrades at city hall that would include windows and climate control.

Bade said he was pleased the city and energy department have been able to work toward a resolution so the grant can be used in Flint.

"These retrofit activities would result in significant savings," Bade said. "The energy savings would benefit the city for years to come."

ANGRILY TOLD RESIDENTS AT THE HASKILL MEETING THERE WOULD BE NO INDICTMENTS COMING OUT OF THE DEPARTMENT OF ENERGY GRANT OR ANY OTHER ACTION. HE CONTINUES TO PROMOTE WALLING DESPITE INDICATIONS OF CORRUPTION IN HIS ADMINISTRATION AND THE STRONGLY WORDED REPORT OF sNYDER'S REVIEW TEAM.

At the hearing on the street lights, Howard Croft admitted to a resident the Department of energy grant was not being reinstated. They claimed they have another appeal.
