Little has been heard from Davenport about his efforts.

John Capenter and crew filed for a 527 political corporation and a PAC. But word is John has withdrawn from the leadership role. He is said to still be involved, but just not in charge.

Other leaders of the group have issues. Sutton is heavily into conspiracy theories and Singelis has image problems.

Supposedly Busch was hired to deal with the language problems, but some say he has already withdrawn.

Simplify the language and move on.

A recall is a waste of time and energy. If the recall made the ballot it would not be until May 2011. The mayoral primary is in August and Walling would be eligible to run in the primary even if he were recalled in May. We would all be better served if we put our time and energy into finding a viable candidate for mayor and campaigning against Walling in the next election.

Then why is Davenport,Carpenter,Singeles telling people that it could be on the August ballot if the signatures were collected quick enough.

There saying that because they have no idea how the timeline works for making the ballot. If they really busted butt to gather the signatures and get them validated they may be able to pull of a November election, but it would be impossible from today to make the August election. This is based on the actual process itself and the timeline for the different phases. Been there done that.

Derrick- Bossman is right. Carpenter was warned the language would not pass, but singelis and Sutton chose to fight for their absurd (in my opinion) language. They enlisted the help of Art Busch, but he may have backed out.

The August deadline passed over a month ago. The way these guys are operating, they will miss the November deadline andprobably the February deadline. Don't forget there has to be time to verify the signatures, deal with any challenges (and there will be), and get it to the state before it can go on the ballot. Singelis and Sutton have not passed the first challenge-that of getting clarity in the language. if they filed on Tuesday, it could take another 20 days for a hearing.

After losing in a Circuit Court hearing to have their first language approved, new language was submitted and turned down. The twist this time is the recall group has hired Art Busch to represent them and they have been assured by Leyton that the language will be approved if some wording is changed .

Sadly leyton did not take a stand in the vote and abstained from fulfilling his responsibilities. He has not bothered to show up at the previous meeting. He did however veto Davenport's language.

Davenport needs to file a PAC and quickly. He can file a waiver if he expects to receive and spend less than $1,000.

A complaint filed in January of 2009 was recently informally settled. There was enough evidence to reasonably agree that violations ocurred within sections 24 and 36 of the Michigan Campaign Finance Act.

From the Secretary of State Administrative Law Examiner Melissa Malerman:

"Under the Act, a committee is required to file a statement of organization with the designated filing official within 10 days of its date of formation. MCL 169.224 (1). In addition, a political committee must file an annual campaign statement disclosing its contributions and expenditures on or before each January 31. (MCL 169.235 (1). The failure to timely file these records may result in the assessment of late filing fees or other penalties. MCL 169.224 (3), (5)."

The Secretary of State documents clearly address the requirement of a PAC, Political Action Committee, when forming a recall. Confusion in the Clerk's office has allowed this provision to be violated in the past. A clear example was Eric Mays who never filed during his Williamson recall efforts although he told the media he raised over $7,500, far in excess of the $500 limit. This gave rise to the erroneous belief that a PAC never had to be formed until a recall passed all steps to be put on the ballot.

Now I fully expect the Committee for a Better Flint to receive fines and it would be a demonstration of Democratic Party interference if they didn't. The reason i say this is the same individual who filed this complaint also filed in 2000 against the John Hightower formed group trying to elect Jeff Wright. When pressed to explain why they didn't file, they manufactured donors from the Detroit area. Jim Kiertzner, in one of his famous "gotcha" stories thoroughly debunked that claim. Hightower was hit with a $6,000 fine.

The Citizens for a Better Flint actually tried to form a charitable non profit (501[c]4) to cover their donors. Citizens United vs FEC did not significantly alter MIchigan law on recalls, so a PAC had to be formed.

An IRS complaint was also filed against citizens for a Better Flint (CBF).

CBF must now disclose their source of contributions and expenditures. Anticipate a less than honest reporting.

Hey Eashoo, why recall him when there ain't no nobody any better to pull into that office? I would run myself, buy can't on two conditions a.) I no longer live there and b.) I am a white guy who ain't going to shuck and jive for the Concerned Pastors ( or whatever the hell this busybody group renamed themselves) . Why don't Libs ( looking at you Bankert and/or Lil ACORN) piss and moan about that group being so entrenched in the politics of Flint as they are? I haven't seen people twist themselves into pretzels lately and explaning why Libs embrace Black pastor's involvement in the political process while scorning white pastor's involvment in the same arena give rise to Libs becoming pretzels.
