Attorney General Mike Cox claims that was illegal and is taking legal action to force them to pay it back. Taryn Asher had more.

Council members were tight lipped Monday. They're waiting until they get a copy of the complaint. They say they still haven't even seen the lawsuit that says their actions were illegal.

Back on July 1, the council approved a resolution introduced by Flint Mayor Don Williamson to reinstate more than $235,000 in retroactive back pay and benefits.

The money had been cut after the city's finances were taken over by the state in 2002. About a month ago, Flint state Sen. Bob Emmerson originally raised the question, and Monday Cox answered it, claiming that according to the state constitution, elected officials are not allowed to collect retroactive back pay.

Cox says, quote: "By granting themselves the illegal pay raise, these men and women have helped themselves harm the city."

Depending on how long this drags out, City Attorney Tom Donnellan says he fears this lawsuit could cost the city that is obviously financially struggling a ton of money.

"What I would like to do is sit down with them and find out what it is they want to do about this particular case, and maybe get some additional information from the attorney general that would assist the city attorney's office in coming up with some conclusion."

Donellan will only be working with the council members for a short time, as last week Williamson introduced new City Attorney Trachelle Young, who is expected to take over Donellan's duties next week
