Potter only received the money for programming the alarms which could run Five to seven thousand. Potter said ABZ was supposed to send him a 1099 for income tax purposes but they had not for the three years of invoices. Although he had received close to $50,000 in that three year period, Potter said he had not paid IRS taxes because he lacked 1099's.

It was Potter's work with ABZ that led to his contract with the township. The township allowed Potter to continue as a consultant as an employee of Abz and as a township consultant when he was making recommendations for purchases.

Norm Riopelle was re-interviewed by Randy Petrides of the Prosecutors Office, Capt. Compeau, and Sgt. Shanlian. He was accompanied by his attorney, Lee carey. Although he was there on an investigative supoena and was granted immunity unless he committed perjury.

Despite immunity, I found him to be less than forthcoming. Despite the three-way phone conversations between himself, Potter and Delaney, he changed his story to it was his decision to drive the generator out to the Warwick Holly Academy.

He changed his previous testimony about how long he was there and who he left with. This also contradicted the statements of others. He believed it was proper because it was a public school although the school leased buildings and the property.

DAVE HOBSON RE-INTERVIEW

Assistant Prosecutor Randall Petrides, Capt. Compau, Atty. Leo Carey, and David Hobson present.

At the time of the interview, Hobson was a 12 year employee with the Grand Blanc Township DPW. His title was foreman for the technicians.

The interview started with the April 8th, 2000 water leak at Warwick Pointe Academy.

Hobson stated he believed Dan Potter was one of his bosses even though he knew Potter was a DPW consultant. Hobson picked up the key to Warwick Pointe Academy and opened the facility for Waldorf. He showed where he had been told the leak was and gave them a phone number to call him should a problem arise.

Hobson believed Potter was on the township payroll as an employee.

The leak had been known for at least a week.

Hobson was the sole person working on alarm calls in the water and waste systems. He also got easements signed for projects in the DPW.

Hobson got a phone call from Waldorf telling him the leak was under the deck and they could not get to the leak by hand shoveling. Hobson said it was his decision to go out to the site. He was there from noon to 5 pm. He was joined by Brian Gleason, who had been working on installing readers for water meters on homes. Gleason was the one who brought the township backhoe to the site. Delaney came as the job was concluding..

However Potter had testified the he, Hobson and Delaney had been on a three way conversation prior to the decision to bring the backhoe. Hobson confirmed here were several conversations and he had asked the two what they wanted done.

He told them about the problem and that the backhoe belonging to Waldorf was tied up on another job He believes it was Delaney that told him to get the backhoe, but with all of the phone conversations he wasn't sure. But he had permission to bring the backhoe to the site. He and Gleason were paid Saturday overtime rates.

The theme continues to be how the work they did for Delaney was no different from what they do for any township resident. However they also point out that work beyond the curb box in the right of way is the job of the property owner. The Warwick leak was definitely on the property owners side,

Delaney had the water running through three separate building and the leak was in the third.

In July of 1999, Hobson and the mechanic, Chillcutt, had gone out to pull out a tractor that had been stuck mowing grass after a complaint was issued. They received a all from Riopelle to meet him at the corner of Baldwin and Saginaw. They meet Riopelle after retrieving the tractor. He had never seen Riopelle driving the generator truck before and he was surprised. Hobson was told to follow Riopelle to the school and take him back to the township offices.

When they arrived at the school in Holly, Riopelle took the truck to the back of the building. Bill Delaney ended up driving Riopelle back.

Hobson heard the construction crew needed power.

Bill Delaney had Hobson order a water meter from Aetna Supply for Warwick Pointe Academy. The meter was billed to the township. When the meter arrived, it was given to Delaney. A seasonal worker and son of Daniel Potter, Jason Potter, was taken by Delaney to the Academy to install the meter. Jason had done meter installations for the township prior year while on summer break.

Hobson was angered at the insinuation that he had ordered the wrong meter. He knew it was the meter Delanaey ordered because township meters read in cubic feet and this meter measured in gallons. Delaney was given the invoice.

Note: a 2 inch meter is a large meter and the monthly bill would be high. The township was set up to read the meters and bill based on cubic feet, so billing for gallons would have been tedious.

Jason Potter confirmed he installed the meter.

An employee of the township had reported the use of the 5 seasonal employees moving furniture for Delaney on township time to the township police The information was passed on to Captain (then Sgt.) Rariden.

The police were also notified that Delaney had requested the generator truck be taken into Oakland County by Norm Riopelle. Rariden was again notified.

Regarding the April 8, 2000 incident at Warwick Ponte Academy:

Officer- "I noticed that Dave Hobson, who was foreman over DPW workers and another DPW employee by the name of Brian Gleason, were in on a Saturday. And I started asking questions of course after joking with them about overtime and what not. Come to find out they had Dave Hobson working on Warwick Pointe Academy, either water line or sewer line. This was, the work he was doing, was supposedly work where the owner was responsible for. In other words the owner of the school would have to pay out of pocket for repairs that they were doing to the school on township monies."

The officer went on to state that it was unusual for employees to be working on a Saturday and they usually only came in for emergencies. The police had obtained and made copies of the time records for both incidents.

Two of the township officers had taken photographs of Delaney driving a township truck out to the Holly School and returning to the township offices with two tractors, on a trailer. They believed one tractor belonged to Delaney , but one was owned by the township. They were stored for a time at the township..

Delaney not only would have access to vehicle keys in the DPW office, but some employees left the keys in their vehicles. This would have been on a Thanksgiving week end.

The John Deere tractor belonging to Delaney was seen in the mechanics bay area and was stored at the township for an unknown length of time. This aldo was reported to Rariden.

When Compeau interviewed township technician Brian Gleason on the April 8, 2000 incident at Warwick Pointe Academy, Gleason stated he was working on changing meters for the new water radio reading system. He indicated Dave Hobson contacted him on the radio to take the backhoe and go to Warwick Pointe Academy because there was a problem with the water line there.

After fueling up the backhoe, he went to the school, arriving between 12:30 and 1:00 p.m.. He excavated where he was told and the leak was eventually repaired.
Note: this is not the stuck tractor story of Hobson.

Dan Potter arrived later, but Gleason was busy. Hobson was helping with the hand digging. He left between 4:30 and 5:00 p..

Gleason said he did not talk to Hobson about the overtime as Hobson got overtime almost daily . If questioned about Hobson's overtime "because if you do ,it's none of your business and you're gonna you know, catch some hell for it because his, you know, his overtime is his business." The incident was not discussed with him.

Gleason said he was basically never told anything as it was on a need to know basis.

Gleason was paid overtime, but he said he believes only Riopelle or Delaney could approve the overtime.

Gleason was upset about being asked to work at the school on township time and told a family member that he didn't think it was right.

While he never performed any other work for Delaney, Riopelle had requested he dispose of building materials at Riopelle's home during a construction project there.

Gleason had confronted Delaney about the seasonal workers knowing that he had an appointment with Compeau about the backhoe at Warwick Pointe. After Compeau had called Gleason for the appointment, Gleason had received a call from Riopelle.

Riopelle talked to him in the parking lot and said the 2 hour long interview did not go well. Hobson specifically addressed the April 8th, 2000 incident. Gleason said he knew the interview was regarding the overtime issue,

Gleason: "He indicated to me that you (Compeau) were kinda upset with him during the interview and that you had to shut off your tape recorder several times during it because you were upset or something."

Gleason told Compeau he would not allow anyone to dictate how he testified. He said Delaney knew he was there with the backhoe, and if he had been asked he probably would have done the work for free because he liked Delaney. He indicated Delaney knew he needed the money.

Gleason said he had installed a water meter and repaired another one for the school, however that was a township related job.

Compeau interview with Steve Chilcutt from Grand Blanc Township.

Chilcutt discussed comments made by Riopelle how having township staff move the furniture just wasn't right. Chilcutt stated he did not feel it was right either. He was supposed to help fix a tractor on July 28, 1999, when the call came to meet Riopelle at a specific location and follow him.

They went to the Holly Pointe School and watched Riopelle park the generator truck for the electricians to power the construction crew.

He did not witness the water line repair but he heard Riopelle and Hobson discuss the extent of the work. Chilcutt was surprised Hobson was usng the backhoe as he was now a supervisor.

Delaney had Chilcutt repair his personal vehicles such as a motor home and an old Cadillac hearse. This was done on township time. Delaney had taken Chilcutt with him when he purchased the car. The cadillac sat in the parking lot for a time and then it was just gone.

Delaney brought in tractors owned by himself or the Warwick Academy school. Usually he worked on them himself, but he had Chilcutt repair the difficult stuff.
