Flint city councilwoman files complaint saying peer is a danger to other members

FLINT, MI - Flint City Councilwoman Kate Fields has filed a complaint against councilman Eric Mays saying he is a threat to other council members.

"He has bullying tactics where he follows you and tries to intimidate you and screams at you even after the meetings," said Fields, who filed the complaint on behalf of herself and five other council members.

The complaint dated Nov. 23 and was presented to City Attorney Stacy Erwin Oakes, Flint's Interim Human Resource and Labor Relations Director Charley McClendon and Clerk Inez Brown.

According to the complaint, Fields filed it on behalf of Council President Kerry Nelson, Council Vice President Vicki VanBuren and members Jacky Popular, Wantwaz Davis and Scott Kincaid.

"As members of the City Council, we believe that Councilperson Eric Mays is a danger to members of the legislative body (especially women) and, basically, anyone who voices a disagreement with him - whether it is within the context of a formal meeting or after meetings," wrote Fields in the complaint signed by the five other council members.

The complaint also points to personal attacks, abusive name calling and verbal altercations.

A rift between Mays and councilmembers has been consistent for some time. The opposition grew even more during a trash dispute where all council members but Mays took Flint Mayor Karen Weaver and her administration to court over the issue.

The dispute was finally settled after the trash company being pushed by Weaver's camp became the center of a federal investigation.

Mays says the complaint is false and his opposition to council members is why he is being targeted.

"I'm the minority council person," said Mays. "It seems to me they always rule me out of order. They put time restraints on me. I feel like I'm ganged up on and legally I filed one damage claim and it was successful because of their tactics. I filed another one and if it's not successful I will file a lawsuit."

Mays filed a damage claim after he was handcuffed and escorted out of an August special city council meeting.

He signed an agreement Sept. 9 to settle the claim for the $4,500 payment. He received the payment, minus $534.02 he owed to the city for property taxes and a water and sewer debt of $654.47.

Mays later filed another damage claim after he was removed from an October meeting. So far, there is no word on whether he will receive a second settlement.

"I'm really disappointed and embarrassed that they would take their politics to such a low level," Mays said. "I think the fabricated complaint being made and signed on by other council people is really borderline as it relates to false complaints. I can never say what a person believes in their mind, but I know I'm no threat to Kate Fields or anyone else."

Fields filed another complaint March 2 regarding an incident with Mays in February. According to a response to Fields from Erwin Oakes, Fields' complaint of Mays' behavior in a February meeting was supported by witnesses but rules were not broken.

The November complaint was also filed with Genesee Prosecutor David Leyton's office.

"There are actually federal laws against this kind of behavior," Fields said. "He's unpredictable. You never know what he is going to do."

This isn't Kerry Nelson's "first time to the Rodeo" with Eric Mays. I believe it was the Riviera Party Store that was up for a renewal of their liquor license. Mays had a contract that he would lobby for the license renewal and Nelson angered him by steadfastly demanding the place be cleaned up. Nelson had visited and was appalled by the trash, the loitering and the open drug sales. His constituents complained and Nelson was responding to their complaints.

The argument between Nelson and Mays continued into the hallway and Mays challenged Nelson in a threatening and angry manner. It appeared that Mays wanted to force his way into the council offices.

Nelson filed a PPO and had to appear in court multiple times as Mays fought the PPO.

The dark side of Erick Mays

1, Wendy Forrest

Case 86-85229-DC Washington

A child was born to Eric Mays and Wendy Forrest on February 25, 1986.

The first Temporary Restraining Order (TRO) was filed by the Legal Services of Eastern Michigan on May 9, 1986. The allegations stated Mays "forcibly took the child from Ms. Forrest's custody." and that he constantlyvows to take the child if Wendy does not abide by his wishes.

Paragraph 11 "The respondent is emotionally unstable and is angry that Ms. Forrest will not reconcile with him".

The complaint went on to state that "on or about February 12, 1986, while 8 &1/2 months pregnant, Mays beat Wendy with a leather belt. She was taken to the hospital and Mays was arrested. Wendy entered into a shelter for battered women on May 7, 1986 and remained in the shelter at the time of the TRO .request.

TRO signed by Judge Val Washington on May 15, 1986

Mays threatening harassing.
(1) November 8th-sid he was "watching her every move" accused her of being with other men and threatened o blow away everyone in her house"

(2) On November 15, 1986, Mays told Wendy to watch a channel 12 (WJRT) special report entitled "Murder by Number" in which Mays appeared and discussed his relationship with Wendy. He admitted to having a gun and rejected the WJRT professionals opinion that he should dispose of the weapon. Mays further stated he "considered the relationship to be a permanent arrangement "till death do us part".

(3) On Tuesday, November 11, 1986, at 11:30 pm, Mays went to Wendy's mother's house looking for Wendy and the child and wanted visitation with the child. Angered when asked to leave, Mays pulled a gun 357 Magnum) on Wendy's brother Roger and his friend. While the friend was allowed to leave, Mays continued to hold the gun on Roger and threatened to kill him.

Mays was charged (87-037457-FH, Ct. 1 Felonious Assault, Ct 2 Felony Fire Arm. Mays pled guilty to count 1 in a plea bargain and nolle prosequi was filed as to count 2. 12 Months probation.

(4) Thursday, November 24, 1986-Mays follows Wendy into Legal Services offices demanding to know what her business was there. Wendy was frightened and called the police. Police tried to remove Mays from the premises, but Mays gave the police resistance when they tried to get him to leave the area. Wendy stated she feared Mays was "emotionally volatile".
The staff of Legal Services requested a TRO on November 24, 1986. (granted)
The staff cited the above incidents and sought to enjoin Mays from entering the premises or "assaulting, injuring, or interfering with the staff.

The saga continues. Mays has a warrant for Wendy's arrest alleging violation of visitation. Wendy files an affidavit on April 3, 2000:

After separating from Mays, Wendy demanded that he leave her home and he refused. Wendy then left and went to her grandmother's home in Grand rapids. She stayed at a shelter in Ionia for 30 days and then a Grand Rapids shelter for an additional 30 days before she obtained employment.

Mays sporadically visited his son, but refused to accept the fact that the child was in special education. Wendy sometimes had to give him money so he could return to Flint.

Visitation ended between December 1998-1999. Wendy's statement was that Mays had been verbally abusive of his son, was poking the boy with his finger, and threatened to spank him with a belt. The boy was begging his father not to spank him, according to the record.

Wendy ordered Mays to leave and told her son "if he hits you again, I am calling the cops and he is going to jail." She stated Mays left while "cussing, swearing, hollering and threatening."

The affidavit continued to state how in December of 1999, Mays called Wendy and wanted her to sign a paper that would give him the money being held in the Friend of the Court. Wendy then alleged Mays demanded full custody and said his mom would care for the boy. The warrant was issued after Wendy's poor eyesight prevented her from arriving on time for a hearing as she hd to take a bus. The affidavit goes on to say that Mays drove from Flint to Grand Rapids and threatened to remove the boy from the care of the maternal grandmother.

The warrant was dismissed.

Mays was found in contempt of court for his failure to pay his child support and a bench warrant was issued on April 12, 2004.

Note" Patsy Lou Williamson told me she had paid a considerable amount of money to pay the delinquent child support. She was rightfully upset when mays then turned on her husband with a recall.

Mays had multiple stories on the financing of the reall. He told me he was given $7,500 by James Patton of Complete Towing for the recall and told others he only got $5,000. Who knows the truth.

Shontelle Dent-00-219693 Judge Newman signed the PPO on 1/25/00. It was not contested by Mays and Mays later denied knowledge of the PPO. I can't imagine a Judge signing without proof of service.

The PPO was filed in January 200 and showed 4 incidents gong back to October 14. 1998:
January 19,2000-Mays allegedly had a woman from Saginaw call and threaten her. Shontelle stated the woman was told by Mays to tell her he would kill her and her mom and he would vandalize her car.

October 25, 1999- Mays spotted Shontelle going North on Saginaw Street, made a U-turn and followed her so closely that she stated she was afraid he would ram her bumper. He pulled up next to her and raised an object that she feared was a gun and called her a .. repeatedly.

October 20,1999-Shontelle and her new boyfriend saw Mays in the parking lot of her apartment and decided not to return to her home.

July 3, 1999- Mys followed her on Dort Highway and kept pulling up next to her and cursing her. He called her a .. because she would not go back with him. He then threatened to kill her and attempted to strike her at a traffic stop. She was forced to speed off.

Approximately October 14, 1998 while returning from the racetrack o I-69, Mays got angry because Shontelle wanted to go to a party with her friends. Mays then began cursing her nd he struck her across the face. He then hit the accelerator and threatened to kill both o them, while holding her down with one hand.

Mays and his second felony:

Arneice Hooper in Saginaw.

Arneice filed this complaint on 1/2/01 and alleged mays was threatening and stalking her and her daughter, Justice Coleman. Hooper further alleged Mays followed, threatened and hit her at her place of work.

"I had a PPO against him in 1999. Eric sits in front of my house all day and all night. He sleeps in his car. He follows me around, He calls my house threatening me. He calls my family. He has pulled a knife on me in front of my daughter and told me he would kill me, my daughter, and himself before the police arrived.

He pulled a knife on me when I was pulling up to work at 6 a.m. He hit me in my eye twice and forced me into my truck, telling me he was going to kill me.

"Yesterday Mays came knocking on my door threatening me. He called my sister and told her something was about to happen so she better make her respect him"

Here is the incident hat led to the felony charges:

Witnesses: Rosie Davis (mother) and Linda Oates (friend)

All three witnesses stated Mays had threatened them during the day and that Mays had been parked in front of Hooper's home most of the day. Mays followed them as they attempted to leave and at one point allegedly tried to run them off the road. Mays struck Hooper's vehicle . The police could hear the arguing and threats by Mays after a cellphone call was made to 911.

Convicted of Aggravated Stalking on 5/24/02

1) Must comply with drug and alcohol testing

2) Must complete Batterers in Transition Program at Saginaw Psychological

3) Must not initiate, establish, or maintain verbal, written, electronic or physical contact with Arneice Hooper, or her family, including parents, Rosie and Edwin Davis, or be within 500 feet of their residence or place of employment.

4) Must not engage in any assaultive, abusing, or intimidating behavior.

5) must submit to a search of your person, motor vehicle, or residence for controlled substances, firearms, or stolen property without need of a warrant.

1st violation of probation hearing 9/23/02
Count 1 of violation of probation order- The offender's agent called Nancy of Batter's in Transition Program and verified the offender had not attended any sessions.

2nd Violation of Probation- 12/16/02

On 11-12-02 the defendant was unsuccessfully terminated from the Batterer's in Transition Program at Saginaw Psychological for violent behavior during a session.

Al Coven and Local 699 in Saginaw

In May of 2000, Eric Mays was elected Recording Secretary of Local699 in Saginaw. Just over a year later, Mays was suspended from his office.

In April of 2002,a Local 699 Trial Committee found Mays guilty of harassment stemming from an argument with Al Coven, Local 699 President. The argument began after Mays confronted a Local 699 secretary that had filed a grievance against Mays. Mays was asked to leave the premises and he refused. Criminal Trespass charges were dismissed after the Saginaw Sheriff Department failed to serve a supoena to Coven and Coven did not attend the trial.
