On November 12, 1998 a complaint was issued by the Department of the Attorney general, Criminal Division. This complaint charged Joseph Larry Wilson with one count of misconduct in office and one count of willful neglect of duty. D/Sgt Larry Willson and S/A Donovan motley appeared before 68th District Judge Michael McAra. Judge McAra reviewed the complaint and authorized the warrant.

On Friday, November 13, 1998, Joseph Wilson, accompanied with his attorneys, surrendered to Willson and Motley at the office of the Criminal Division of the Attorney General. Wilson was fingerprinted and photographed before being debriefed according to the agreement made.

Willson and motley then accompanied Wilson to the 68th District Curt where he was arraigned on the charges in front of District Court Judge Nathaniel C. PerryIII. After Wilson waived the reading of the complaint, he pled guilty to count II, the willful neglect of duty . Count I was dismissed.

The plea was accepted and the Judge sentenced him at the time:

1. $500 fine;

2. Continued cooperation in the investigation of corruption in Genesee
County corruption; and

3. Wilson must resign from hs position as Sheriff of the Genesee County
Sheriff department effective December 3, 1998.

The Interview:

Wilson was interviewed by he staff of the Criminal Division of the Department of the Attorney general on November 13, 1998.

GUN PERMITS AND SPECIAL DEPUTY BADGES

This discussion began with the fundraiser held in Oakland county. An individual in the Genesee County Sheriff's Department advised Wilson an owner of a Genesee County food store in Genesee County had business friends in Oakland County who were interested in becoming "special deputies". In addition Wilson was told that these business men were considering moving their businesses to Genesee County.

This same Sheriff department employee told Wilson the business men were interested in holding a fundraiser for Wilson in Oakland County. Originally the party was to be for 8 to 10 people but grew to 25 to 30. The attendees were to pay $300 and be offered an opportunity to apply for a special deputy badge. It was decided $300 would cover the expenses of food, beverages and entertainment as well as cover the cost of applying for special deputy badges and ID.

This Sheriff department employee and Wilson went to the fundraiser in late January or early February and Wilson carried in the blank applications and camera equipment. Wilson and the employee took photos and helped with the applications. The owner of the residence collected the fees and set up the strippers. Wilson said the strippers made him uneasy but he did not believe the engaged in any acts of prostitution at the party.

"Wilson stated someone at the party talked to him about how difficult it is to get a concealed weapon's permit in Oakland County. Wilson stated he told this individual if you had a valid reason; i.e., a businessman who carried large sums of money, etc, then you could qualify in Genesee County. Wilson stated he also told this individual that Genesee County was somewhat liberal with concealed weapons permits. "

When the money was handed over to Wilson, the Sheriff department employee handled the money while Wilson carried the equipment to the car.
originally the money count was $6,700. A recount was $6,500 and counting
error was the explanation for the $200 dollar difference. Back at the office a third count was $6,200. Wilson said he didn't care about the money.

The money was placed in a drawer for safekeeping and eventually placed in the Explorer fund. The applications for badges were prepared by staff and the Oakland County applicants were notified when they could pick up the badges.

When the five arrived at the Sheriff Department they met with Wilson and were taken to the conference room. Wilson told them they needed a Genesee County address to apply. He did not remember telling two staffers to allow the men to use their addresses, but it may have been implied by virtue of his being the Sheriff. Wilson said by the time of the Gun Board, these individuals would have moved their businesses into the county . "He further stated that he did not feel it was a crime to do this because if by the time the applications were reviewed by the Gun Board they did not have Genesee County addresses, the Gun Board would deny the applications.

Wilson admitted signing Benthalls name as well as that of Kennedy. He agreed it was possible hat he signed other Police Chief names. He only did so to speed up the process for the applicant. He stated he had done so in the past and then notified the chief whose signature he signed . He doesn't remember any chief asking him not to sign for them. While calling this a gray area, he did not believe he committed any crime.

Prior to the five men from Oakland receiving their notification of meeting the Gun Board, the newspaper printed a series of stories about the party and the applications were withdrawn.

CAMPAIGN FINANCE VIOLATIONS:

Wilson named the person who handled the majority of his campaign fundraising activities for either 10% or expenses, which was about 10% of the funds collected. Wilson said money is not a big deal to him and he did not keep track of it. However, he gave instructions not to take corporate checks after a meeting with the Michigan Secretary of State who advised him not to do so.

The individual conducting the fundraisers may have had blank concealed weapon applications in his possession while collecting campaign donations, donors knew the their contribution was not directly ties to concealed weapons permits. he blank applications were a favor to these individuals.

After the investigation began Wilson admitted he became aware how campaign workers, acting on his behalf, accepted corporate checks and cashing them at a specific location and converting them to money orders for deposits.( A female had admitted to cashing at least one corporate check for $3,000 at tat location). He admits this is a campaign violation but does not remember if the workers advised him of this practice.

Prior to the investigation, any cash donations were were deposited in either the Explorers, dare, or Scam account, but not in to the campaign accounts.The LAWS account was for his campaign account.

Wilson sits on the Boards of various community service organizations in Genesee County. As a result he has requested and received donations for those groups. The United Way, Humane Society and the American Red Cross.

There is a confusing story about the $3,000 check because of the whited out names.. Wilson said he never asked anyone to obtain the money from the alleged donor and that alleged donor denied giving the money. Wilson said he was told that an individual deliberated mislead the investigators.i

There was an individual who left the Sheriff Department and was angry at Wilson. This person felt they were qualified to be undersheriff , but Wilson appointed Art Evans to that position. This person is related to the cabal.

Questioned about a friendly relationship and if any gifts has been received as a result of this friendship. Wilson was given plane tickets to Florida, where this friend has a vacation home in 1982 and 1983 (?). Meals and entertainment were also provided while Wilson stayed in Florida.

On one trip, Prosecutor Arthur Busch was also on the plane. This was about two to four years ago and the tickets were paid for by his friends wife. Wilson knows because he was called and told that his and Busch's tickets were ready for pick up.

In 1995 and again in 1996 Wilson was invited to a conference in Acapulco, Mexico that was sponsored by Dow Corning. Wilson's friend did business with Dow Corning and he told Wilson he had 3 to 4 spots for people to use. Wilson accepted and provided services such as security for the conference attendee.
The resort used was the Pier Marquee resort in Acapulco, Michigan. In 1995. Genesee County Prosecutor Arthur Busch also was a guest at the conference.

Wilson admitted helping a Saginaw resident obtain a concealed weapon permit. According to Wilson,addresses did not mean much if the individual had a legitimate reason in Genesee County and did not have a criminal record. Wilson said this individual belonged to a specific organization and he 9Wilson) had attended fundraisers for that Club. "Wilson denied there were topless dancers at those functions".

The FBI was aware of issues involving bribery and public corruption. Threads in Flint talk touched on Mitru, Wilson's campaign person and "brown bag" payoffs.

This was from State gets an F Makokha wants to copy Wilson's fundraising for Woodrow Stanley. Makokha was the only one to go to prison.

In another thread I discussed FBI documents File #194B-DE-72700 from 1994 as they related to the Makokha, Flint Director of Governmental Policy, trial and the waste hauling contracts.

There was a confusing segment about an alleged $30,000 bribe payment made on behalf of Mike Swartz, then owner of Nathan J's, a strip bar on Dort Highway. Confusing because Swartz did not deliver the " brown bag" and the money did not transfer to Makokha in this narration.

The Cooperating Witness (CW) alleges to be a go-between for vendors and Makokha.

"CW stated that he/she was in Wilson's (Sheriff Joe Wilson) office 1n 1993 when Mike Swartz, owner of Nathan J's , called about being denied a topless dancing permit by the City of Flint."

The CW alleged Wilson, Mitru, and Waters were also in the office.
"CW advised that Mitru hung up the phone nd told him/her that Swartz needed some help with the city. According to Mtru, Swartz said he would pay $20,000 "to get this thing done"

The CW then said that Waters warned him to "not to do it" So CW stated he would try to sell Swartz a diamond like his as Miru said Swartz had expressed interest in one like the CW's.

During the media blitz of the Makokha federal trial,CW was alleged to be Harold Hampton. Previous stories focused on Hampton giving security systems free to certain politicians. There was also a scandal involving the sale of the security company building to the City of Flint for a North end Mini-station.
I spoke to two minority contractors who allegedly were told their roof replacement bids were too low and too increase them. They complained the contract went to a contractor who bid higher than them.

Hampton also had a pawn shop in the Lansing area and allegedly gave golf clubs and other gifts to Makokha. spoke to Hampton's ex-wife and she stated Harold's federal deal stuck her with a large IRS bill.

According to the CW, thre was a meeting with Swartz. MItru, and Dan Hogan in Flint. While Swartz did not buy the diamond, he was allegedly still upset about not getting his permit and would now pay $30,000 to "get it done".

CW demanded the money from Swartz in 2 hours in a brown paper bag and delivered to his/her pond in Fenton. CW stated he/she was afraid of being set up by Swartz and he/she figured the FBI or another law enforcement agency couldn't establish surveillance in that short time.

This is where it confuses. Mitru went to his home with the CW and got $30,000 from a home safe in the basement. CW said there was a lot of cash in the safe and Mitru allegedly told him it was Wilson's. There is no discussion of the money going to any city official to make this happen.

The CW met with Makokha 2 days later at he White Horse and CW was said to have told Makokha that Swartz would pay $5,000 for the permit.
