I remember my University of Michigan mentor, Maria DeLeary , conveying that message to her friends and students. She usually spoke it in Spanish, but when she explained the meaning it was basically that you will be judged by those you chose to associate with. We all make simple value judgements, such as whether or not a certain person is the kind of person we choose to associate with. If their values and standard of conduct are lower than ours, we may choose not to hang out with them.

Warrants issued for used car dealership owners in relation to
racketeering case

Genesee County, Michigan — Arrest warrants were issued this morning for
the four used car dealership ownerswho allegedly conducted a vehicle
racketeering scheme, officials say.

Edward Usewick III, 30, of Davison; William Dempsy, 58, of Goodrich; James
Lane III, 46, of Ortonville and Walter Szunko, 54, of Traverse City each face a
count of racketeering and three counts of larceny by conversion in an amount
of $20,000 or more, said Genesee County Prosecutor David Leyton.
Usewick also has been charged with four counts of intent to pass a false title,
he said. He could not be reached for comment.

As of Friday morning, he was not in custody and believed to be in Florida,
Genesee County Sheriff Robert Pickell said.

Usewick, the owner of Auto Brokers LLC, also called Executive Auto Dealership,
4057 S. Dort Highway in Burton, acquired at least 20 vehicles from a leasing
company in Andover, Mass. then sold them through a Flint car auction
company using duplicate titles.

The leasing company that gave the vehicles to Usewick never got paid for the
cars after they were sold, officials said.

Pickell said Flint Auto Auction and the Massachusetts leasing company were
innocent victims in the alleged scam.

Those who purchased the vehicles will be left without the vehicles, which they never owned in the first place, Leyton said, and without the money they paid, he said.

“It’s similar to someone who buys a bad title to a house,” Leyton said. “They end up with nothing.”

Flint Auto Auction officials declined to comment.

Dempsy, Lane and Szunko are all believed to have helped hide the vehicles on their used car lots, Leyton said.

Dempsy operates Great Lakes Auto and Leasing, located on the same lot as Usewick’s dealership. Lane runs Lane Car Company, 2200 Ortonville Road in Ortonville, and Szunko runs Executive Auto Brokers, 2421 Branch Road in Flint, and
another location in Traverse City, officials said.

Mark Latchana, Lane’s attorney, said he believes the allegations against Lane will be proven false. “He’s a businessman and he’s always been honest and forthright with his business dealings,” Latchana said.

Lane will turn himself in early next week, Latchana said. He did not have information regarding the other defendants.

Dempsy and Szunko could not be reached for comment.

Pickell said at least 24 vehicles worth more than $310,000 have been recovered but about 40 more vehicles are believed to have been stolen and at least two other financial institutions lost money.

Edward Frank Usewick III is in the spotlight again as rumors surface about his involvement in the expanding Suski used car dealerships that appear to be imploding.

None of the racketeering cases made it out of District Court based on plea deals made by the prosecutors office. Usewick had the biggest payback and he still owes $43.500 in restitution.

Despite that history, Usewick was made partner in the Suski used car dealerships. The Dort Highway location has no cars and reliable sources say all of the used cars were repossessed last Thursday. I am told that many cars, mostly SUVs are being held in Mt Morris Township.

Usewick also had a federal racketeering case in Wayne County entitled Berry v Usewick.

Untanglingwebs, your not the only savvy sleauth at research...all true, all facts regarding David "Mc" Leyton. He is openly campaigning now to get re-elected. He's done a poor job in my opinion based on the facts, the crime rates, etc.

Leyton accepts political donations from his former prosecuted alledged felons! Ed Useick charged with felonies in 2010 by Leyton is now in 2012, a open supportor, sponsor and politcal donor to the very man that....got him off?

The following is a public invitation, open to the public, for a fundraiser for McLeyton as he calls himself. He invites you to pay for him to solicit to continue his poor work. Tis no Blarney the invite reads. Leyton and his backers, these guys laugh, drink and make merry when people are getting shot almost daily, and turning up dead inmates rather routinely at the jail. it's perverse and wrong.

NBC 2010-FLINT -- Four car-dealership owners face felony racketeering charges.


Edward Usewick, owner of Executive Auto Brokers Used Cars on Dort Hwy, is the alleged ring-leader of the scheme.


Genesee County Sheriff Robert Pickell and Prosecutor David Leyton believe Usewick received cars from a leasing company in Massachussets, but never fully paid for those cars. Then, he and three accomplices sold false titles to unsuspecting customers on those vehicles.


Authorities believe he bilked 63 customers with this scheme.


Edward Usewick, Walter Szunko, James Lane III, and William Dempsey each face 1 count of racketeering (a 20 year felony), and 3 counts of larceny (a 10 year felony). In addition, Usewick faces 4 additional counts of passing false titles, which is a 10 year felony.


Usewick is currently believed to be in Florida. There is a warrant out for his arrest.

HISTORY of betraying his promises to victims families of murdered citizens.



HISTORY of radio broadcasting, and with this background, Leyton's utilizes his media savvy to create a spotlight focused on himself by calling numerous and ultimately un-prosecuted elder abuse new conferences from 2007- 2010, while planning for and running to leave Flint to get elected to another job, rather than sitting at the desk he was assigned and preparing prosecutions, which is what he was elected to do.



HISTORY of campaigning in 2010, while receiving full wages, but only doing part time work at best.



HISTORY of being "out of town," going on vacation, instead of working 9-5 and putting in an honest 40 hour week. Just ask the Virginia law enforcement official when the murder spree of August 2010 was happening. It was reported that Leyton's staff stated Leyton was only available by cell phone. Why? Cause he was "out of town."



HISTORY of reported cheating on his "time cards" when he was Flint Twp. Clerk, a full time position. However, he worked part time while keeping open his law practice. Reportedly, Leyton arranged for township employees to be paid additional hours to make up for the work they did due to his absences.



HISTORY of not paying back his 2010 election loans according to State of Michigan records. He still has outstanding debt on the books for the 2010 failed statewide campaign from himself to himself! Very well done MDimitre.

How about that Ridgeway White was driving a vehicle with Usewick's label-Executive motors.

And Edward Usewick's wife, Cheyenne Usewick has joined ranks with a dealership (Suski I believe) to have a car lot on the site of the old Koert's glass company.

When the demolition was planned of the vermin and cockroach infested house owned by Usewick in the 900 block of East Ninth, Mayor Walling himself stopped it at one point and the neighborhood had to fight to get the demolition done.

The city had a difficult time closing the Fisher Hotel, owned by Usewick, even after years of residents complaints over drug dealing and prostitution being rampant there. Many of the rental homes owned by Usewick were occupied by drug dealers. The individual responsible for the rentals told residents they did not perform background checks before renting their properties.

Usewick did not believe in paying property taxes on his properties and also lost more than one business.

Phil Goldman was said to be in Florida when friends called him about the removal of the cars from the lots last Thursday. His response was that the used car dealerships were in trouble, but the Birch Run location was safe.

Judge Perry was in a downtown restaurant and was not anxious to answer questions about the cases. He stated Leyton plea bargained because the banks dropped the case. (What about the private citizens who lost their cars and their money?)

He closed the case because Leyton told him to. And what about the over $34,000 restitution still owing. The banks didn't want it back. Perry kept shifting his feet and was very uncomfortable. He took his soup to go.

The file now says "restitution satisfied", but it did not say that when I checked on December 23rd.

His first felony was for receiving and concealing stolen property (another plea).

Note the second felony shows $43,578.00 owing. What a nice bank to forgive that much.

Safeco allowed to void insurance policy issued to landlord; claim against agent dismissed



Cheyenne Usewick and her husband purchased homes and sold or rented them for a number of years. They insured the homes through Safeco and a local agent, the Marsh Agency in Genessee County. In 2008, a home they owned in Davison was severely damaged by fire. When Usewick made a claim under the policy, Safeco filed suit to void the policy, claiming that the application for coverage contained material misrepresentations.

The trial judge agreed and granted summary disposition, and Usewick appealed. Safeco pointed to four statements it deemed "material misrepresentations:" Under "maintenance condition," a box had been marked "excellent," a fact that the insureds agreed was inaccurate. The agent had checked this box after a "drive-by" investigation and a review of the appraisal. He later testified that if he had checked the interior of the dwelling, he would have described the condition as "poor."

Safeco argued that although the condition of the interior played no role in causing the fire, it would not have underwritten coverage on the home if it new the interior was in poor condition and the dwelling unoccupied. The insureds argued that they did not describe the interior as "excellent" and did not notice that their agent had. The Court held that it did not matter where the misrepresentation originated: having signed the application for insurance, the insureds were responsible for the misrepresentation and it allowed Safeco to rescind the coverage.

The Court also pointed out additional misrepresentations that would have entitled Safeco to rescind: the application box asking whether the property was currently "for sale" had been marked "no," which the Court deemed incorrect. The home was occupied by a renter who had signed a contract to purchase the property from Usewick. Furthermore, the Court pointed to the fact that the Usewicks testified they had a general intent to sell every investment home they purchased and the husband had identified another potential buyer for the instant home. Based on these facts, the Court "inferred" that the home was, in fact, for sale at the time of the fire. Again, the fact that the property may have been intended for sale was unrelated to the fact of the fire.

Next, the Court pointed to the box on the application that asked whether the property was "vacant." Although the Court looked to the fact that a tenant had moved in and signed a purchase agreement as demonstrating the property was for sale, it also noted that the tenant testified that he moved in about one month after the Usewick purchase of the home to hold that the home was actually "vacant" when it was insured. The insureds maintained that Safeco's position failed to take into account prior rulings holding that rented dwellings will always be vacant for a temporary period between tenants, making the question of "vacancy" one of timing and intent.

Lastly, the Court pointed to the fact that the application box addressing "under construction or significant renovation." The box had been marked "no" and the Usewicks claimed that restoring the kitchen did not qualify factually, and that, in any event, they did not make this entry or give this information to their agent. They considered this entry to be the agent's professional opinion. The Court deemed the entry to be a material misrepresentation given that substantial drywall work needed to be done on the first floor and the kitchen had been gutted.

Lastly, the Court held that the lower court had not erred in summarily dismissing the Usewick claim against the local insurance agent. The court held that since Usewick did not supply any evidence that she had provided the agent with more accurate information, she could not argue that the agent was responsible for errors he had included in the application that Usewick signed.

The Usewicks bought a house in Davison (the Safeco case) for $162,000 because it had a fire and water damage. They insured the house for $290,000 and sold it days later on a land contract dated March 7, 2008 to Gemale Tyler for $290,000. Tyler was allowed $30,000 to make the repairs to the house within a 90 day time frame or the house would go back to the Usewicks. Tyler was to pay interest only with a balloon payment of $260,000 after 2 years. No payments were required in the 9 day time frame set aside for repairs. Tyler was also required to insure the house.

A second fire in the home occurred on November 5, 2008. Davison Township later
demolished the home.

Tyler did not make repairs and did not make payment. A forfeiture action was started on March of 2009 and completed on August 12,2009.

Tyler requested the first $260,000 of his insurance policy and Pacific wanted to prorate their liability on the basis of another insurance policy on the second property. Both denied.

The appeal was held at the Michigan Liquor Control Commission in Southfield regarding the transfer of the liquor license from Muggys, Inc. to Cruisin1, Inc. on 405 South Dort. It also requested an additional permit for Sunday AM sales and a second bar.

The applicant was Cheyenne Usewick , who was represented by her attorney Michael Jablonski, to appeal the July 8, 2011 denial. The denial was based on her being named as a defendant in a 67th District Court case where she was listed as VP of Executive Auto brokers, also a defendant.

The appeal was successful as Jablonski showed the evidence the case was dismissed. The Commission reversed their denial and added that Edward Usewick was to be prohibited from any involvement in the operation of the establishment and Cheyenne Usewick had to prove she gave a $2500 loan to Cruisi1.

False Advertising, Not honor prize winners

This company practices deceptive and dishonest advertising.

Suski mailed their used car flier to my home with a lottery type of contest indicating prizes if won. The flier had a scratch off game wherein if one where to reveal 6 pots of gold after having scratched off only 6 of 36 possible patches, then the prize would be $30, 000 dollars. There were lesser prizes for matching/scratching off and revealing less pots of gold.

I happened to scratch off and reveal 6 pots of gold, and went to claim the $30, 000 prize promised. Suski did not honor their advertised claim, and stated that all I had won was the right to scratch off another card presented at the business to try and win the prize. There was nothing in their advertising mailer that indicated that this would be the situation.

You are absolutely correct. I used to work at that lot and the sales are nothing but a tool to fake people in the door. The prizes are never won and the entire process is to get you to pay the highest price possible on any vehicle on the lot. There is never a price posted on any vehicle and the entire design is to bury you into a car payment and stretch your budget as far as they can. I have seen profit on car sales that are over $10, 000 each and in most cases they sill make even more money on the back end (warranties, gap insurance... etc). What most people do not know is that the actual owner of Suski Used Cars is not Andy Suski. The owner is Ed Usewick and he has made an arrangement to use the Suski name. Ed Usewick has been arrested in the past for passing false titles, selling lease vehicles he did not own, bouncing almost $500, 000 of bad checks to Flint Auction and Federal Racketeering charges. Why Mr. Suski has allowed such a person to use his good name I do not understand. I have seen falsified documents, deals with funding companies where the down payments and financial agreements are not true, warranties that customers have paid for not filed with the companies, taking up to two months to get their license plates and being issued multiple temp tags in the process, the list goes on. Suski Used Cars does not have the proper sales or finance licensing for its locations and why the State has not closed them down, I do not know. My suggestion would be to find another dealer to buy a car from, Suski Used Cars is the type of place that give our business a bad name.

I don't understand why Leyton prosecuted this case when it involved interstate commerce. To me the appropriate venue was the Federal Court, The leasing company was in Andover, Massachusetts and the cars had to be transported here. The Flint Area Auto Auction took a hit as did two financial institutions.

Also the case was racketeering and that does not seem to me to be a local case.
