New Detroit judge says health keeping her off bench

Detroit — A TV station says a new Detroit judge is getting paid but hasn’t worked, more than two months after her term began on Jan. 1.

Kahlilia Yvette Davis won election to Detroit’s 36th District Court. She tells WJBK that she had surgery and has an infection. She says she doesn’t want to put the courthouse at risk.

WJBK aired video of Davis going to Sam’s Club, a credit union and a gym.


Chief Judge Nancy Blount has asked Davis for more written evidence of her health problems. Blount says she hasn’t received a “satisfactory statement” from a doctor.

Davis says Blount is giving her a hard time because she defeated a relative in the election. Blount denies any retaliation.

District Court judges are paid about $140,000 a year.

She doesn't want to put the court at risk, but she can go to a gym and shopping? Detroit activist, Sam Riddle, and others are defending her, but you can bet this story has legs.

(WJBK) - Being a judge is hard work. And one local politician campaigned hard to win a seat on the bench.

But now that she's a judge she isn't working hard. She isn't working at all. She isn't working but she's collecting a six-figure salary of our taxpayer money.

Can you really call in sick to a job that you've never even worked a day at?

This is the 36th District Court in Detroit. It's the busiest court in the state. There are 30 judges here and 29 of them sit on the bench every day hearing cases.

But one judge has never sat on the bench. Never heard a case. Her name is Kahlilia Yvette Davis.

Rob Wolchek: "How come you haven't been on the bench yet?"

"Excuse me," Davis said. "Because I've had surgery. I have an infection. I have an open wound so if you want Staph infection all over the courthouse, you might want that."

Kahililia Davis billed herself as a successful attorney when she campaigned last year.

She appeared on faith based programs urging people to vote for her, admitting she'd had health problems in the past that Jesus had healed.

"Jesus is my doctor and he writes out all my prescriptions" she sang in a video.

Detroit politician, Kahlilia Davis, campaigned to be a judge for the 36th District Court. Davis won her seat on the bench and she is 1 of 30 judges. However, all of them have sat on the bench except for Davis and the city of Detroit wants answers. She advertised herself as being experienced and honest. However, many people are wondering if Davis is still following the policy of being honest. Her term began on January 1st but she hasn’t worked in 2 months.

Problem Solver’s Rob Wolchek, from Fox 2 News , decided to confront the judge while cameras were rolling at her home as he wondered if you could call in sick on a job that you never worked. Rob Wolchek: “How come you haven’t been on the bench yet?” “Excuse me,” Davis said. “Because I’ve had surgery. I have an infection. I have an open wound so if you want Staph infection all over the courthouse, you might want that.”

While she admitted during her campaign that she had health problems, Davis said that Jesus had healed them and that she was ready to work. “Jesus is my doctor and he writes out all my prescriptions” she sang in a video. images-9 In December, Kahlilia Davis was sworn in but she asked to go to Germany before she started her term. However, Chief Judge Nancy Blount denied her vacation request. Then, she informed the judge that surgery would prevent her from serving on the bench. However, Davis has not provided paper work stating that she’s unable to work.

Judge Blount gave Wolchek a written statement. As chief judge of the 36th District Court, I am required to monitor judicial attendance. Judge Kahlilia Davis was elected to our court in November of 2016 and her term began on January 1, 2017. I do not have a satisfactory statement from her doctor as to why she has been unable to work. The documentation is requested from any judge who will be absent from the court for an extended period of time. Any lengthy absence creates a hardship on the court and the public.

On the days that Davis was supposed to be in court, she was out and about at Sam’s Club, the gym and the credit union. Even though she was running errands, Davis claims that she’s still too sick to serve. However, she needs to provide the proper paperwork. Hopefully, she’ll be on the bench soon.

Davis participated in Ballotpedia's 2016 survey of local judicial candidates. The following sections display her responses to the survey questions. When asked what non-judicial legal experience qualifies her to be a judge, the candidate made the following statement:
“ First and foremost, I have an average of two days' per week experience handling the traffic/misdemeanor docket at 36th District Court. There are only two people in this race who can say that they have worked the traffic/misdemeanor docket at the court on a consistent basis.[2][3] ”

When asked why she was running for this particular court seat, the candidate made the following statement:
“ We have a constitutional right to a jury of our peers, but it is rare that we encounter a JURIST of our peers. I think it's high time that the people of the City of Detroit have opportunity to elect someone who understands them because she is one of them - a regular person who has struggled to accomplish all that she has without having been born with a silver spoon in her mouth. I am the only candidate running that was born, raised, and continues to live in a regular Detroit neighborhood (Mack and McDougall area) rather than dwelling in an exclusive and restricted enclave patrolled by private security.[2][3]

There were for (4) candidates for the two (2) open seats in the nonpartisan race for 36th District judge in Detroit. Kenyatta Jones received 34.44 % of the votes followed by Kehlillia Davis with 24.46 %. Close behind Davis was Christopher Blount with 24.19% of the vote. According to Davis, Blount is a relative of the chief judge. Richard bowers came in with 16.9 % of the vote.

Wayne County has had numerous judges reprimanded recently. But does this problem exist in Genesee County also.

In 2007, Jim Kiertzner, although he had left Flint and moved to Channel 4 in Detroit, received a letter pleading for help from the then 68th District Court:

"Please help us employees at the District Court. Irma Chenevert is out of control and the union has sold us out. She hires her friends to work here that live outside the City of Flint and Genesee County. She violates city labor rules like giving out comp time to her favorite pet employees, and blames us because Ms. Pitts was told about it.

Now she has hired a convicted drug addict and sex offender to work here. This is an outrage that a man who used his position as a Circuit Cort Probation Officer to have sex and drugs with the men he was supervising should be working here! Surely they can find somebody to work here that is not a registered sex offender.

We fear for our jobs if we speak out. We fear for our own safety because this drug addicted pervert is here. If somebody is molested or attacked by this man who will pay for the lawsuit that will be filed. Why is nobody protecting our safety. Help us please!!!"

On July 1, 2007, The local newspaper The Flint Enquirer, printed the story "68th District Court Officials hire staff from outside of Flint."

"A controversy is brewing at the Flint (68th) District Court over some recent personnel changes. The flint Enquirer has learned that officials from Flint District Court recently hired several non-residents of Flint as new temporary employees.

Reportedly, Interim Flint District Court Administrator Irma Chenevet, who herself is a resident of the City of Detroit, hired new employees from the Detroit area, and from other communities outside of Flint. Some of thee new employees are members of a Detroit area church that Chenevert attends.

The Enquier spoke to Flint District Court employees under the condition that their identities not be revealed. Thee employees indicated that morale among staff at the Flint District court has reached an all low due to what is perceived as "cronyism" and "nepotism" over the last year.

Reportedly, several of the judges at the court were very upset that court officials hired several nonresidents of the City of Flint for thee positions in part because Flint has suffered with one of the highest unemployment rates in Michigan.

One employee told the Enquirer that they were disappointed that these employees from out-of-town have worked at the court for months while many young people who live in Flint have not been considered for employment. It is truly sad that the people who pay taxes that fund the Flint District Court cannot have their fellow citizens hired, even for temporary positions.

Chenavert was appointed Interim Court Administrator last year by Judge Archie Hayman when former Court Administrator Lynette ward unsuccessfully challenged Judges William Crawford and Herman Marable for a judgeship in the 2006 election.

The Enquirer could not reach Judge Archie hayman for comment. Hayman is the Chief Judge of the Genesee Circuit court as well as the Flint District Court. Hayman was appointed to the dual positions in 2006 by Michigan Supreme Court Chief justice Clifford Taylor.

The Enquirer will keep its readers informed of further developments.

(Note: There is no longer a Flint Distric Court as it has been merged into the 67th Genesee County District Court)

Craig Anthony Justice
was prominent in news stories during 2002 during his court case in front of Judge Hayman..

The allegations focused around how the 8 year state employee working as a Genesee County probation officer, Craig Anthony Justice, then 39, used his position to have sex and share alcohol and cocaine with one of his male probationers.
Although Justice pleaded guilty to one count of second degree criminal sexual conduct, a 15 year felony, and the use of cocaine, a 1 year misdemeanor, he only received a year in jail and was required to register as a sex offender.

After reading the July 26, 2007 memorandum from Irma Chenevert, I found the employee fears of reprisal to be valid.

"I must report an unfortunate occurrence. I received notification from the City of Flint Department of Human Resources and Labor Relations that an anonymous note was submitted indicating that Compensatory Time was being awarded to staff. Because of this, the Administration Team will no longer be able to show our thanks to staff members who go above and beyond their normal work duties.

As many of you may or may not know, this was our effort to try and boost morale along with saying thank you. I am sorry that someone felt slightd and chose to hurt others by this act."


Flint has a policy about the awarding of compensatory time.
