Genesee County Circuit Judge Geoffrey Neithercut has issued an ultimatum to the city of Flint - either pay it, or we take it.

Flint officials have until Wednesday to pay $130,000 for the installation of utilities at the stalled Sugar Maple Farms subdivision.

Judge Neithercut says if Flint City Hall refuses, he will order the money taken from the city's checking account.

The money will be used to install water, sewer, gas and electricity at Sugar Maple Farms subdivision.

Three homes have been built there, but are not finished.

Freeman Greer, one of the homeowners involved in the case, hopes the judge's ruling will mean he can finally move into his new house. "That's about the most positive movement we could have foreseen. We had no idea he would do that but I think that's fantastic."

Work on the subdivision stopped after two real estate developers went bankrupt.

Previously Judge Neithercut had ruled the city issued the building permits, so it's up to Flint to pay to get the essentials hooked up.

If and when the city writes the check for $130,000, the new equipment will be ordered.

All the utilities could be installed by the end of July. After that, the new houses, which have sat vacant for two years, can be finished and families finally allowed to move in.

Attorney Michael Joliat, who was representing the city, had no comment on the judge's ruling.
