The City Council subpoenaed two top city officials over theshifting of nearly $800,000 without council approval.

City Administrator Peggy R. Cook and Budget Director Ron Jackson are expected to appear before the council's finance committee on Wednesday to answer questions about the move. The council also will question City Attorney Trachelle Young, who the council said agreed to appear without a subpoena.

The subpoenas are the latest in a battle between the council and Mayor Don Williamson over the city's 2004-05 budget that includes a lawsuit now pending before Genesee Circuit Judge Geoffrey Neithercut.

John Schlinker, the council's attorney, said shifting the funds -?hich allowed the city to avoid layoffs in key posts, bring back about 10 employees and reopen the Civil Service Commission offices - might be illegal. He said the council is considering legal action or handing the issue over to state officials for further investigation.

City officials say a resolution approved by former emergency financial manager Ed Kurtz allows the funding move that they argue were necessary to continue basic city operations after the council refused to fund those areas
