Topic: Michigan's Retreat Laws

The State of Michignan requires every individual to make every effort to retreat be fore using force until you are either in your bedroom, or your place of business.

I bring this up because of a recent event that happened at my home. Three obviously drunk individuals were walking past my home one night. They were hollaring profanities and such. (no big deal) Then, one of them started harrasing a woman warming up her car. calling her ".., hoar, ..."
He then started yelling "thats my car!! Get out of my car!! I'll kill you .."
It was obviously not his car as his freinds laughed as they held him back. They kept telling him to "quit playing."

He then turned towards me and yelled "you want some?" This continued for about 3~4 minutes. e said "I know where you live, I'll kill you and your whole family"

This is when I pulled the hammer back on my pistol. I never showed it, or even said a word back to him. I called the police, and ofcourse they arrived late enough to completly miss the whole thing.

The problem I have is, I believe him when he threatens my wife and 4 mo. old son. Yet, I have to wait until he breaks into my house, follows me up the stairs, and into my bedroom.

I question weather or not I would let him past the front door. Also, there are other concerns. What could I've done if he attacked the woman? My bedrooms on the second floor; what if he started a fire on the first?

My question is, when should I be allowed to use force against a threat to me and my family?

The second somebody enters my house without invitation, I feel my life is in danger and I need to protect my family. I seriously doubt that intruder would get out alive. Depending upon if the guy was repentent or not would determine if he received a quick merciful death or I had a little fun with him "inquisition style."

I think we recently changed the laws so that you can gun down someone when they break into your house if you are threatened instead of forcing you to run away so they can steal whatever they want to. I think the trial by jury law might also help people that defend themselves and prosecutors might not want to prosecute someone for that but I'm no attorney.

You were very smart to avoid confrontation. Those guys were drunk and out being stupid. Not a reason to die. You, or them.

You almost had your Bernard Goetz moment there.

weather they were just being stupid or drunk, is relatively irrelevent. The risk to me and my family may be small, but the consequence of them following through are unacceptable. If they would have taken any action towards carring out their threat, I would have responded with serious force and determination.

Jay Jenkins, I'm not a lawyer either, but try www.legislature.mi.gov and use deadly force in Key Word Search. The links in the search results may give you at least some of the information you seek. I'd suggest reading them all. There was a change in 2006 though that one may not be related to your personal situation.

In my opinion, guns cause nothing but grief. Particularly in the hands of those who are not trained to use them properly. On the other hand, I understand why some feel the need to have them in their homes to protect themselves.[/i]

I understand your disagreement with weapons. I agree that in general they cause pain and suffering. I wish there was not a need for them. However, I believe that that they are needed. I personally feel it is an integral part of my home protection defense strategy. I also, have served 4 years in the US Marines and qualified as a rifle expert. While in service, I was trained and patroled with the MP's for a year of that tour. I also, trained to get my CCW and event graduated from the class. However, I never got the certificate because it was too expensive. I hope that my background will put you more at ease. And let us both hope for the day when guns are only used in sport.
